Opis:V diplomskem delu je obravnavana tematika s področja potrošniškega kreditiranja v Sloveniji, s predstavitvijo Zakona o potrošniških kreditih ( ZPotK-1 ) in poudarkom na obligacijsko pravnih posledicah pri sklepanju potrošniških kreditnih pogodb. V drugem poglavju avtor definira pojma potrošniška kreditna pogodba in potrošnik po ZPotK-1, ter jih primerja z ureditvijo po Zakonu o varstvu potrošnikov in Zakonom o obligacijskih razmerjih. Prav tako prikaže razmerje med ZPotK-1 in obligacijskim zakonikom (OZ). Sledi prikaz razvoja pravne ureditve potrošniškega kreditiranja v Sloveniji od leta 2000 naprej, ko je bil sprejet Zakon o potrošniških kreditih (ZPotK-2000), ki je kot prvi celovito uredil področje potrošniškega kreditiranja. Tretje poglavje je namenjeno predstavitvi zakonskih obveznosti pred sklenitvijo potrošniške kreditne pogodbe. Avtor predstavi področje oglaševanja potrošniških kreditov, ki pomembno vpliva na potrošnikovo izbiro, kateri kredit bo najel. Sledi obveznost zagotovitve predhodnih informacij, ki jih je kreditodajalec dolžan zagotoviti potrošniku. Poglavje se zaključi s predstavitvijo obvezne ocene kreditne sposobnosti potrošnika in informacijskega sistema SISBON, ki sta namenjena izpolnitvi načela odgovornega posojanja denarja. V četrtem poglavju se avtor ukvarja z zakonsko predpisano obliko in sestavo potrošniške kreditne pogodbe ter z možnostjo spremembe njenih pogodbenih določil. Potrošniška kreditna pogodba mora biti sestavljena v pisni obliki in mora vsebovati vse zakonsko predpisane informacije, ki jih je ZPotK-1, v primerjavi s predhodnikom razširil (kreditna obrestna mera, efektivna obrestna mera, znesek kredita, pravice in obveznosti pogodbenih strank, skupni stroški kredita, zavarovanja, obdobje trajanja itd ..). Peto poglavje prikazuje različne načine prenehanja kreditnega razmerja in njihove posledice. Najpogostejši razlog prenehanja kreditnega razmerja je odplačilo potrošniškega kredita v skladu z dinamiko odplačevanja po potrošniški kreditni pogodbi. Vendar temu ni vedno tako, saj poznamo tudi ostale načine prenehanja, ki so posledica kršitev potrošniške kreditne pogodbe s strani kreditodajalca ali potrošnika (razdor kreditne pogodbe) ali drugih dejanj pogodbenih strank (predčasno odplačilo kredita, cesija itd ..). V šestem poglavju avtor na kratko predstavi posebne oblike potrošniških kreditnih pogodb oz. kreditov (finančni leasing, hipotekarna potrošnika kreditna pogodba, pogodba o dovoljeni prekoračitvi, povezana kreditna pogodba), za katere velja ZPotK-1 ter našteje potrošniške kreditne pogodbe za katere ZPotK-1 ne velja. Sedmo poglavje služi predstavitvi sodne prakse s področja potrošniškega kreditiranja. Avtor predstavi tri sodne primere (dva primera iz slovenske sodne prakse in enega iz sodne prakse sodišča EU). Diplomsko delo se zaključi z osmim poglavjem v katerem avtor poda sklepne ugotovitve.

Opis:This diploma thesis covers the field of consumer crediting in Slovenia trough a presentation of The Consumer Credit Act (ZPotK-1) and with an emphasis on obligational legal effects on concluding consumer credit agreements. In the second chapter the author defines the term Consumer Credit Agreement and Consumer through the Consumer Credit Act (ZPotK-1) and compares them to regulations in the Consumer Protection Act and the Obligations Act. He also presents the relationship between ZPotK-1 and the Code of Obligations (OZ), followed by a presentation of the development of legal arrangements in the field of consumer crediting in Slovenia from 2000 onwards, when the Consumer Credit Act (ZPotK-2000) was accepted. This act was the first to fully regulate the field of consumer crediting. The third chapter deals with legal obligations before concluding a consumer credit arrangement. Author presents the field of advertising consumer credits, which has a great influence on the consumer’s decision which credit to take. The next subject is the obligation of the creditor to provide the consumer with pre-contractual information. The final subject of the chapter is the presentation of obligatory consumer’s creditworthiness rating and the SISBON information system, which are intended for fulfilling the principle of responsible money lending. In the fourth chapter the author deals with legally defined format and structure of the consumer credit agreement and possibilities of changing the agreement provisions. The consumer credit agreement must be drawn up in writing and must include all legally defined information that were added to ZPotK-1 in comparison to its predecessor (credit interest rate, effective interest rate, amount of credit, rights and obligations of the contracting parties, total credit costs, insurances, agreement period, etc.). In the fifth chapter one can find different possibilities of terminating the credit relationship and their consequences. Most frequent cause for terminating the credit relationship is repayment of the consumer credit in accordance with the repayment profile defined in the consumer credit agreement. But this is not always the case as we also know other possibilities for termination resulting from breach of consumer credit agreement on the part of the creditor or the consumer (rescission of the credit agreement) or other acts from contracting parties ( early credit repayment, cessions, etc.). In the sixth chapter the author gives a brief presentation of special types of consumer credit agreements or credits (financial leasing, mortgage consumer credit agreement, overdraft facility, linked credit agreement) that are subject to the ZPotK-1, and list consumer credit agreements that are not subject to ZPotK-1. In the seventh chapter one can find a presentation of judicial practices in the field of consumer crediting. The author presents three legal cases (two examples from Slovenian judicial practices and one judicial practice from the EU Court of Justice). The diploma thesis is ends with the eighth chapter in which the author gives his conclusions.
