Opis:Razveza zakonske zveze ne poteka v vseh državah na enak način. Nanjo vplivajo različni dejavniki in eden izmed njih je tudi vera. V Izraelu poznajo zasebno razvezo zakonske zveze, ki je v Sloveniji ne poznamo. Pri nas za razvezo zadošča civilna razveza, v Izraelu pa je potrebna še verska razveza. Za zasebno razvezo zakonske zveze je značilno, da po civilni razvezi mož in žena gresta še pred beth din, ki je rabinsko sodišče, kjer mož ženi izroči get dokument. Get dokument je tisto, kar razlikuje razvezo zakonske zveze v Sloveniji od zasebne razveze zakonske zveze v Izraelu. Je dokument, ki vpliva na razvezo, prav tako pa mož in žena z njim dokazujeta razvezo. Mož ga mora dati svobodno in žena sprejeti brez prisile, prav tako pa mora ta dokument izpolnjevati točno določene pogoje glede oblike, sestave, vsebine in predaje. Ko je vse to izpolnjeno, pride do dokončne razveze zakonske zveze. Med postopkom razveze zakonske zveze lahko pride do številnih težav, ki jih povzročita mož ali žena. Lahko se zgodi, da mož iz različnih razlogov ne želi dati geta. V tem primeru, ob točno določenih pogojih, lahko beth din prisili moža, da izroči get. Če mož še vedno ne upošteva ukaza, ga doletijo sankcije. Če žena ne pridobi get dokumenta, ostaja v očeh judovskega prava še vedno poročena. Enako velja za moža, če žena noče sprejeti get dokumenta. To situacijo imenujemo agunah. Oba sta priklenjena na zakonsko zvezo, v kateri ne želita ostati, nima pa to za oba enakih posledic. Ženina zakonska zveza velja za prešuštniškega, če se poroči brez get dokumenta, kar pa ne velja za moža. Ženska agunah se poleg tega spopada še s problemom mamzer. Mamzer je »nezakonski otrok« ali »pankrt«, ki se ženi rodi v novi zakonski zvezi in ta stigma mu prinaša številne težave ter ga lahko zaznamuje za celo življenje. Kakor nekoč, tako tudi danes oblasti rešujejo problem agunah na različne načine. Ena izmed rešitev je pogojni get, ki ga mož da ženi pred odhodom v vojsko. V nekaterih državah problem agunah rešujejo z zakonodajo. Primer take zakonodaje je newyorški zakon get.

Naslov:PRIVATE DIVORCE - EXAMPLE OF ISRAEL
Opis:Divorcing a spouse differs from country to country. There are many factors that have an influence on the way people can do it, and one of them is religion. In Israel there is private divorce, which is unknown in Slovenia. In our country civil divorce is enough, in Israel however, there is an additional requirement: religious divorce. What is significant for »private divorce« is that after the spouses have been through it, they have to appear in front of beth din, which is a rabbinical court, where the husband gives his wife a get document. It is this get document that makes an Israeli private divorce different from Slovenian divorce. It is a document, which influences the divorce and with it the ex husband and wife prove their divorce. It has to be given freely by the husband and the wife has to accept it without any constraint. It has to fulfil certain conditions concerning the form, composition, content and handing over. When all the mentioned has been fulfilled, it can come to the final divorce. Many problems can appear during the procedure and they can be caused by either the husband or the wife. It can happen that the husband will not want to give his wife the get for different reasons. In this case beth din can, under exactly determined conditions, make the husband give the get. If the husband still does not pay regard to the order, he is sanctioned. If the wife does not acquire that document, she remains married in the eyes of the Israeli law. The same is true for the husband if the wife does not want to accept the get document. Such situation is called agunah. Both stay stuck in a marriage in which they do not want to stay, however the consequences are not the same for both of them. The wife's marriage is considered an adulterous marriage if she gets married without the get document which, however is not true for the husband. The woman's agunah has to deal with the problem mamzerin. Mamzerin is an illegitimate child or bastard, who is born in the woman's new marriage. Such person has to face numerous difficulties and remains stigmatised for a lifetime. The government has been dealing with the agunah problem in various ways. One of the solutions is the conditional get (bill of divorce), which the husband gives his wife before he joins the army. In some countries the agunah problem is solved with legislation. An example of such legislation is the New York Get Law.
