| Opis: | This Master’s Thesis provides an overview of the multifaceted landscape of insolvency law and directors’ responsibility in a corporate bankruptcy in the European Union (EU). It highlights the challenges in harmonising insolvency legislation across EU Member States and the role of supranational frameworks like the European Insolvency Regulation (EIR) in advancing cross-border insolvency regulation. The thesis discusses key aspects such as jurisdictional issues, the role of insolvency practitioners and the issues relating to forum shopping in insolvency cases. Additionally, the research paper highlights the EU's initiatives to establish a coherent and unified approach to these challenges through regulations like Regulation 1215/2012 and the EIR. Ultimately, the thesis emphasises the need to continue a dialogue, collaborate, and to harmonise of legal principles in order to effectively manage cross-border insolvency cases while safeguarding the rights of all stakeholders within the EU. |
