Abstract:Cestni promet poteka po cestni infrastrukturi, le-ta pa je v okolici, ki ima svoje zakonitosti. Cestno prometno varnost definiramo z znanimi faktorji varnosti. To so: človek, vozilo, cesta in okolica. Iz navedenega lahko sklepamo, da je potrebno zagotoviti sinergijo med posameznimi faktorji in širše, med vsemi elementi, ki kakor koli vplivajo na odvijanje cestnega prometa. Cestni promet je voden na osnovi pravnih virov. Ne smemo zanemariti tudi miselnosti oziroma psihološke komponente udeležencev v cestnem prometu. Prevoz blaga in potnikov v cestnem prometu poteka na osnovi postavljenih pravnih virov. Praviloma se v domačem prometu uporabljajo domači pravni viri in v mednarodnem prometu mednarodni pravni viri. Za nemoten potek prometa doma in v tujini je značilno, da so pravni viri med seboj primerljivi, saj so na primer prometni znaki povsod enaki in imajo isti pomen. Mednarodni pravni viri so: konvencija o pogodbi za mednarodni prevoz blaga po cesti CMR, konvencija za mednarodni cestni prevoz potnikov in prtljage CVR, konvencija za mednarodni cestni transport TIR, evropski sporazum o cestnem prevozu nevarnih stvari v mednarodnem transportu ADR in bilateralni sporazumi med državami. V domačem prometu se uporabljajo pravni viri.

Title:THE ROLE OF LEGAL SOURCES IN ROAD TRAFFIC
Abstract:Road traffic is carried out along the road infrastructure which is laid randomlyin the environment and subject to meteorological circumstances. Road traffic safety has been defined by the knowen elements of safety: man, vehicle, road and environment. Consequently it is necessary to ensure synergy between the above elements, as well as generally between all other elements which affect road traffic in any other way. Road traffic is directed on the basis of legal sources. We should also not neglect mentality or psychological components of participants in road traffic.Transport of goods and passengers in road traffic is organized on the basis of set legal sources.As a rule in the domestic traffic national legal sources are used and in the international traffic international legal sources are used. For a tranquil course of traffic at home and abroad it is typical that legal sources are comparable, as for example traffic signs are the same everywhere and have the same meaning. International legal sources are: CMR – the Convention on the Contract for the International Carriage of Goods by Road, CVR – the Convention on the Contract for the International Carriage of Passengers and Luggage by Road, TIR – the Convention for the International Road Transit, ADR – the European Agreement concerning the International Carriage of Dangerous Goods by Road and bilateral agreements between countries. In the domestic traffic legal sources are used.
