Title:TEORETIČNI POGLEDI NA RAZVOJ KONSENZUALNOSTI V SODOBNEM KAZENSKEM POSTOPKU

Abstract:S ciljem povečati učinkovitost sodobnega kazenskega pravosodja mnoge države iščejo rešitve v uvajanju različnih oblik konsenzualnih postopkov, ki dopuščajo strankam v postopku določeno stopnjo avtonomije pri razpolaganju s predmetom obtožbe. Možnost pogajanja o predmetu obtožbe in kazenski sankciji, ki v najbolj očitni obliki pride do izraza v konsenzualnih postopkih, ki sledijo ameriškemu plea bargaining, poraja med teoretiki različna stališča in argumente, predvsem v luči temeljnih procesnih načel in ciljev na katerih temelji kontinentalni kazenski postopek. Pojem konsenzualnosti v sodobnem kazenskem procesnem pravu v najširšem smislu vključuje vse tiste postopke, skozi katere se v skladu z načelom oportunitete v večji ali manjši meri daje obdolžencu možnost, da vpliva na končni izid kazenskega postopka. Skupna značilnost vseh konsenzualnih postopkov je, da so vezane na priznanje krivde obdolženca. Kljub mnogim teoretičnim stališčem, ki govorijo proti konsenzualnim postopkom, jih mnoge kontinentalne države v okviru reform kazenske zakonodaje sprejemajo in prilagajajo svojim notranjim pravnim ureditvam. Še vedno je razbrati previdnost evropskih zakonodajalcev pri predpisovanju pogojev uporabe konsenzualnih institutov, saj načeloma pridejo v poštev v primeru lažjih oziroma srednje težkih kaznivih dejanj. Trendu širjenja konsenzualnosti v kazenskem postopku sledijo celo mednarodna kazenska telesa, katerim se posledično očita izgubljanje legitimnosti in spodkopavanje ideje restorativne pravičnosti.

Title:THEORETICAL VIEWS ON DEVELOPMENT OF CONSENSION IN MODERN CRIMINAL PROCEDURE
Abstract:With the aim of increasing efficiency of modern justice, countries are seeking solutions in the introductions of various forms of consensual procedures which allow parties in proceeding certain degree of autonomy in disposing with the subject of criminal procedure. The possibility of negotiating on the subject of the allegations and penalty, which is in most obvious form reflected in consensual procceding who follow american plea bargaining, raise different views and arguments among the theorists, especially in light of fundamental criminal principles and objectives on which continental criminal procedure is based. In the broadest sense, concept of consesion in modern criminal procedure includes all procedures through which is a lesser or greater extend given a possibility to defendant to affect the final outcome of criminal procedure. Common feature of all consensual procedures is that in some way they are all related to guilty plea of defendant. Despite many theoretical views which speak against consensual procedures, there are many countries who are, in the context of criminal law reforms, accepting and adapting consensual forms to the internal regulation. It is possible to deduced a certain caution from continental legislatures in prescribing the condition for use a consensual forms. In principle they are still applicable in case of minor or medium heavy offenses. Even international criminal tribunals are following the trend of spreading the consension in criminal procedure. Because of that they are accused of lossing the legitimacy and demolition the idea of restorative justice.
