Title:RAZVOJ MEDNARODNOPRAVNIH INŠTRUMENTOV ZA BOJ PROTI TERORIZMU

Abstract:Teroristični napad na World Trade Center v New Yorku in Pentagon na domačih tleh ZDA leta 2001 je povzročil mnoge spremembe v delu mednarodne skupnosti in posledično pripeljal do vrste povračilnih ukrepov, med drugim tudi do vojaškega posredovanja. V diplomski nalogi najprej predstavljam poskuse definicije mednarodnega terorizma, še posebej različne konceptualne pristope k definiciji, saj večina avtorjev še vedno opozarja na pomanjkanje univerzalne definicije in raje opisuje pojem terorizma. V drugem poglavju predstavim mednarodni boj proti terorizmu, kratek zgodovinski pregled, reakcijo držav članic Evropske unije v povezavi s tem vprašanjem in pojasnjujem pojem dejanj, ki so povezana s terorizmom. Naštejem mednarodne univerzalne inštrumente boja proti terorizmu in jih na kratko predstavim, Nato se osredotočim še na mednarodne inštrumente regionalne narave — to so inštrumenti Evropske unije in Sveta Evrope. V nadaljevanju opišem tudi zgodovino boja proti terorizmu v Republiki Sloveniji (pred in po napadu na WTC), proces implementacije naštetih in opisanih dokumentov v zakonodajo Republike Slovenije in razvoj in intenziteto boja proti terorizmu v Republiki Sloveniji, še posebej v luči vstopa naše države v Evroatlantske povezave. Namen diplomske naloge je zbrano in celovito predstaviti pregled mednarodnih, tako regionalnih kot univerzalnih, dokumentov v boju proti terorizmu in se do njih kritično opredeliti.

Title:The Development of International Legal Instruments for Action to Counter-Terrorism
Abstract:The terrorist attack on the World Trade Center (WTC) in New York and the Pentagon on the United States soil in 2001, has caused major changes in the functioning of the international community and, consequently, a series of retaliatory measures by the use of military force. In my paper, I first present the definition of international terrorism, especially the different conceptual definitions of terrorism, since the majority of authors points to the lack of universal definitions, and therefore prefer to describe the concept, as defined. Further, I present forms, as well as the causes and targets of terrorism. In the second chapter I outline the view of the international fight against terrorism, a brief historical outline of the activities, the reaction of European countries in relation to this issue, and the incriminated crimes in connection with terrorism. I further identify the development of international instruments of universal character and briefly describe the most important international instruments in the framework of the United Nations and within individual bodies of the United nations: the General Assembly and Security Council and Secretary-General special bodies. I continue with the description of international normative instruments of regional character within the European Union and particularly the Council of Europe. I also describe a process in the Republic of Slovenia in terms of development and intensity of the fight against terrorism before the terrorist attack on WTC, and after this period, especially in light of the entry of Slovenia into the Euro-Atlantic integrations - NATO and the timeline review of national legislation. The purpose of my paper is a comprehensive and collected presentation of international aspect of the fight against terrorism, and the presentation of international legal instruments of universal character and regional character in the fight against terrorism and critical assessment of their effectiveness.
