Abstract:
Diplomsko delo predstavlja zemljiški dolg v slovenskem pravu. Opredeljen je kot pravica zahtevati poplačilo denarnega zneska iz vrednosti nepremičnine pred drugimi upniki s slabšim vrstnim redom. Poleg predstavitve samega instituta in problematike, ki zavira njegovo uporabo, sem zaradi podobnosti obeh institutov predstavila tudi nekaj prednosti in slabosti zemljiškega dolga v primerjavi s hipoteko.

DIE GRUNDSCHULD
Abstract:
DDie Diplomarbeit stellt ein relativ neues Institut im slowenischen Recht vor, das sich trotz guter Anwendbarkeit und hoher Flexibilität in der Praxis nach wie vor nur schwer durchsetzt. Die Grundschuld wurde mit Inkrafttreten des sachen rechtlichen Gesetzbuches eingeführt und definiert sich als Berechtigung, die Zahlung einer Geldsumme aus dem Grundstückswert vor nachrangigen Gläubigern zu fordern.
