Title:PRAVNA UREDITEV POSVOJITEV PRI ISTOSPOLNIH PARTNERJIH V RS IN PRIMERJALNEM PRAVU

Abstract:Družina je temeljna celica vsake družbe. Naše družinsko pravo šteje za družino življenjsko skupnost staršev in otrok. Če izhajam iz tega, da ima vsak otrok pravico do družine, potem ni potrebno govoriti o pravici otroka do točno določenega tipa družine, pač pa do družine, ki naj bo stalna, trdna in njegova lastna. Ureditev pravic istospolnih parov se razlikuje od države do države. Nekatere nimajo niti zakonodaje, ki bi istospolnim partnerjem omogočala minimalne pravice, spet druge pa istospolno usmerjenim omogočajo registrirati skupnost ali celo priznavajo zakonsko zvezo dveh istospolnih oseb. Bolj liberalne države, kot sta npr. Švedska in Nizozemska, istospolnim partnerjem omogočajo celo posvojitev otrok. Znotraj teh, se ločijo tiste države, ki omogočajo posvojitev otrok drugemu partnerju (prvi partner je biološki starš tega otroka) in tiste, ki dovoljujejo skupno posvojitev. Po naši veljavni zakonodaji, lahko posvojijo otroka le poročeni heteroseksualni pari in posamezniki, za zunajzakonske in istospolne pare pa je posvojitev otroka le želja, ki je na ozemlju naše države še ni mogoče uresničiti. Glede na to, da je trenutno v Sloveniji mnogo govora o predlogu novega Družinskega zakonika, je del naloge namenjen tudi spremembam, ki jih le ta prinaša, predvsem na področju posvojitev. Osrednja tema naloge je pravna ureditev na področju istospolno usmerjenih, glede pravice do posvojitve otrok, v nekaterih državah Evrope, predvsem pa v Sloveniji, ter možnosti družinskega življenja za geje in lezbijke. Osredotočila sem se predvsem na pravo ureditev tega problema pri nas in pogledala kako se s to problematiko spopadajo druge države. Slovensko ureditev sem primerjala z drugimi evropskimi državami. Izhodišče mi je bila Nizozemska, ki je prva uredila položaj istospolnih partnerjev pri posvojitvah in ga praktično izenačila z raznospolnimi partnerji. V diplomskem delu je predstavljena tudi ureditev drugih evropskih držav, ki so na omenjenem področju naredile največ ter analiza omenjenega vprašanja v ZDA. S pomočjo anonimnega anketnega vprašalnika, sem ugotavljala, kakšna so stališča Slovencev glede posvojitev znotraj istospolno usmerjenih. Svojo raziskavo sem primerjala s podatki agencije Delo Stik, ki je v letu 2006 naredila analizo raziskave z naslovom Istospolna partnerstva, saj mi je bil eden izmed ciljev ugotoviti, če je v zadnjih letih prišlo do večje naklonjenosti javnosti do istospolno usmerjenih.

Title:LEGAL REGULATION OF ADOPTION BY SAME-SEX PARTNERS IN THE REPUBLIC OF SLOVENIA AND IN THE COMPARATIVE LAW
Abstract:Family is basic cell of every society. Our family law considers family as community of parents and children. Every child has a right to his own family and there is no need to speak about child right to a certain type of family, but about a family that should be permanent, solid and his own. Rights of same-sex couples vary from state to state. Some doesn’t even have legislation that would give them minimal rights, when others enable them to register community or even give them the right to get married. More liberal states, as are Sweden and Holland, give them the option to adopt children. Those states are separated on those who give a right to adoption to second partner (first partner is a biological parent of a child) and others, which allows them joint adoption. Our valid legislation allows adoption only to married heterosexual couples and individuals, but extramarital and same-sex couples can only wish to get a child through adoption. Considering that there is a lot of discussion about a proposal of a new family legal code in Slovenia at the moment, a part of dissertation is dedicated also to changes that it brings us, especially on area of adoptions. Main subject of dissertation is legal regulation on area of same-sex oriented, about a right to adopt children in some European countries, especially in Slovenia, and possibilities for gays and lesbians family life. I focused especially on legal regulation of this problem in our country and checked how other countries deals with it. I compared Slovenian regulation with other European countries. Holland was the first country that arranged situation of same-sex partners at adoptions and practically equalised it with heterosexual partners. In dissertation is also introduced legislation of other European countries that did most of work on mentioned area and analysis of mentioned question in USA. I was figuring out what is the opinion of Slovenians about adoption regarding same-sex oriented with anonymous survey.
