Title:ANALIZA POSTOPKA OPLEMENITENJA BLAGA Z EKONOMSKIM UČINKOM NA PRIMERU FITOFARMACEVTSKEGA SREDSTVA

Abstract:Hrana je strateškega pomena za vsako državo ali zvezo držav. V zadnjih letih so države, kljub strateškemu pomenu hrane, vse manj denarja namenjale za raziskave v kmetijstvu. Pridelava je začela stagnirati, ponekod pa celo nazadovati. Samo vlaganje v raziskave in razvoj ter upoštevanje rezultatov tega dela nas lahko reši pred lakoto in zagotovi dovolj kakovostne in varne hrane po dostopni ceni. Velik vpliv na manjšo pridelavo hrane ima globalna sprememba podnebja — vse večje pomanjkanje vode (pojavljajo se izredno dolgotrajne suše), orkanski vetrovi, poplave, toče, nenormalno visoke temperature in s tem povezan pojav novih plevelov ter povečanje števila škodljivih insektov. Delno lahko ublažimo te negativne učinke s fitofarmacevtskimi sredstvi (zatiranje plevelov in insektov) delno pa z biotehnologijo, ki omogoča ustvarjanje gensko spremenjenih rastlin, ki so odporne na stresne situacije (suša, vročina). V času vsesplošne globalizacije in skokovitem razvoju mednarodne trgovine, transporta in elektronskega poslovanja podjetja izbirajo različne načine sodelovanja, da postanejo in ostanejo konkurenčna na trgu. Namen tega dela je predstaviti carinsko zakonodajo in postopke, ki olajšujejo pretok blaga preko meje ter hitrejšo trgovinsko menjavo in gospodarski razvoj. V diplomskem delu predstavljam proces oplemenitenja blaga z ekonomskim učinkom. Blago ima značaj nevarnega blaga (fitofarmacevtsko sredstvo) in je podvrženo posebnemu režimu skladiščenja, transporta, rokovanja in trženja. Pomembna je ustrezna izbira embalaže in pakiranja. V teoretičnem delu je prikazana slovenska carinska zakonodaja, zakonodaja s področja fitofarmacevtskih sredstev, zakonodaja s področja kemikalij in prevoza nevarnih snovi. Podjetja, morajo dobro poznati predpise in zagotoviti disciplino ter odgovornost v odnosu do izvajanja teh predpisov. Pomembno je, da se podjetja v carinskih predpisih in poenostavitvah prepoznajo ter na podlagi tega ugotovijo, kateri postopki jim omogočajo boljše poslovanje in prihranek pri denarju in času. Po sklenjenih komercialnih dogovorih z izvajalcem storitve izven Evropske unije se na posebej predpisanem obrazcu vloži na carinski urad zahtevek za izdajo dovoljenja za postopek z ekonomskim učinkom. Carinski urad izda dovoljenje, na osnovi katerega špediter pripravi carinske deklaracije, carinski organi odvzamejo tudi vzorce blaga. Vzorci služijo za dokazovanje istovetnosti vrnjenega blaga. Pošiljki blaga je priložen varnostni list, račun in izjava o poreklu blaga. Prevoz blaga je izveden kot zbirni kamionski ADR prevoz (nevarno blago). Po končanem prepakiranju se blago z ADR prevozom pripelje v Slovenijo. Ponovno se odvzamejo vzorci in po potrjeni istovetnosti se blago sprosti v prosti promet. Carina se plača samo za dodano vrednost. V tem primeru je to embalaža in opravljeno delo. Najpomembnejše ugotovitve v diplomskem delu lahko strnemo v redno spremljanje zakonodaje na področju fitofarmacevtskih sredstev, zakona o kemikalijah, carinskem zakonu in redno spremljanje tržnih dogajanj in spremljanje okolja, saj samo premišljeno izbrani postopki vodijo v racionalno in učinkovito poslovanje podjetja. Po preučevanju različne zakonodaje lahko zaključim, da se le-ta tesno prepleta med sabo in spremembe ene vplivajo na drugo. Nujno je sodelovanje podjetij z državnimi inštitucijami. Razumeti je potrebno tudi vlogo inšpekcijskih služb, ki nikakor ni le represivna ampak je lahko v veliko pomoč pri razumevanju in izvajanju zakonskih določil.

Title:ANALYSIS OF THE PROCEDURE OF GOODS FERTILIZATION WITH ECONOMIC EFFECT ON THE EXAMPLE OF PHYTOPHARMACEUTICAL PRODUCT
Abstract:Food is of strategic importance for each country or confederation. In the last years the countries, despite the strategic importance of the food, assigned less and less money to the purpose of studies and researches in agriculture. Only investing in researches and development as well as the consideration of outcomes of such work can save us from hunger and ensure enough safely grown and processed food of good quality. Great impact on the smaller extend of the food production has the global change of climate – increased water shortages (long-continued rainless weather), stormy winds, floods, hailstorms, abnormally high temperatures and in connection with this the appearance of new weed sorts and increased number of harmful insects.To some extent this negative effects could be alleviated by the help of herbal medicines (suppression of weeds and insects) and partly with biotechnology, which enables the creation of genetically modified plants, which are resistant to stressful situations. In the time of general globalisation and of saltational development of the international trade, transport and electronic operations the companies decide for diverse ways of collaboration so as to be able to compete on the market and to keep the position they have acquired. The concept of this project is to present the tariff legislation and the procedures, by which the flows of goods across the borders could be facilitated as well as the goods exchange and the economic development accelerated. In my diploma thesis the procedure of goods' fertilization with economic effect will be described. The goods have the nature of dangerous goods (herbal medicine) and are subject to special rules for storage, transport, handling and marketing. Important is the use of appropriate packing and boxing. In the theoretical part of the diploma project the Slovenian tariff legislation, the legislation in the range of herbal medicine and of chemicals as well as the legislation in the range of hazardous goods transport will be treated. The consequences of increased integration of Slovenia into international economic flows are perceivable in increased unification of the provisions regulating the flow of goods across the country's borders. After the concluded trade agreements with service providers outside of the European Union on the special prescribed form by the customs office has to be appealed license for the procedure with economic effect. The customs office issue a license on which basis the freight forwarder prepares customs declaration and customs authorities take samples of goods. Samples serve to prove the identity of the returned goods. To consignment of goods a safety data sheet, invoice and statement of origin is accompanied by. Transportation of goods is carried out as truck transport ADR. After repacking the goods with ADR transport are carried to Slovenia. Samples are taken again and after confirmed identity the goods are released into free circulation. Custom duty shall be payable only on value added. In this case this is just the packaging and work. The most important findings of the diploma project can be summed up in regular keeping track of the legislation in the range of herbal medicines, in regular keeping track of the Chemicals Act and of the Customs Act as well as regular monitoring of the market and of the surroundings, as only the thoughtful chosen procedures lead to the economical and efficacious operations of the company.After the study of different legislations I can draw the conclusion, that the legislations interlace closely and the changes of one legislation influence the other. It is necessary for the company to collaborate with the state agencies and authorities. Also the role of the inspectorates must be understood rightly, as they are definitely not only a repressive agency but also a great help assisting us to understand and implement the statutory provisions correctly.
