Title:PRAVICE LATALSKIH POTNIKOV KOT POTROŠNIKOV V PRIMERU ZAMUDE LETALSKEGA PREVOZNIKA

Abstract:Kljub upadu letalskega prometa v tem letu, splošni trendi kažejo na njegovo nenehno rast na letni ravni. Več potnikov pa pomeni tudi več problemov. Eden največjih so zamude. Poznate letalskega prevoznika, ki je vedno točen? Kot potniki – kakšne so vaše pravice? Kako vas pravo ščiti? Česa bi morali biti deležni? Kaj lahko zahtevate? Kako se lahko pritožite in se borite za svoje pravice? Po drugi strani pa – kakšna je odgovornost letalskega prevoznika? Pričujoče diplomsko delo se ukvarja s področjem varstva potrošnikov in s transportnim pravom, natančneje letalskim pravom in se skuša osredotočiti na pravice letalskih potnikov kot potrošnikov v primeru zamude letalskega prevoznika. Zamuda je opredeljena na splošno, posebej v letalskem pravu – njen pomen, klasifikacija in posledice. Iz posledic izhajajo pravice letalskih potnikov, tako do oskrbe kot do odškodnine; opisan pa je tudi način uveljavljanja teh pravic. Ker so pravice enega dolžnosti drugega, ne moremo mimo odgovornosti letalskega prevoznika v primeru zamude, kjer je prav tako opisan zgodovinski pregled do Montrealske konvencije, po kateri omejitev prevoznika pri prevozu oseb več ne obstaja, za kar si prizadevajo tudi v drugih transportnih panogah. Na kratko smo osvetlili tudi zastaranje terjatev. Kar obsežno poglavje pa smo namenili pregledu statistike glede letalskega prometa v Sloveniji in Evropski uniji, statistiki pritožb na Evropski potrošniški center ter navedli možnosti izboljšav problematike.

Title:THE AIR PASSENGER CONSUMER RIGHTS IN THE CASE OF AIR CARRIER DELAY
Abstract:Despite the decrease of air traffic in this year, the general trends are showing the constant annual growth. The more air passengers the more problems to occur. One of the main problems is the delay. Do you know any air carrier that is always on time? As a passenger – what are your rights? How are you protected by law? What is that you should be »given«? What is that you can demand? How can you complain and fight for your rights? On the other hand – what are the responsibilities of the air carrier? The following thesis is dealing with the consumer rights and transport law field, emphasizing the aviation law. The main aim is to highlight the air passenger rights in the case of air carrier delay. The delay is generally defined, especially in aviation law – its meaning, classification and consequences. The air passenger rights burst out of the delay consequences as the right of maintenance as well as of indemnity; the procedure of bringing forward this rights is listed as well. Because the rights of one are the duty of another, we can not eliminate the responsibility of the air carrier in the case of delay, where we also do list the brief historical overview up to the introduction of the Montreal convention that removes the limitation of air carrier in the case of the air passenger transport, what all other transportation fields are willing to achieve. The claim limitation is briefly highlighted. We have put much emphasize in the capture about air traffic statistics in Slovenia and European Union; statistics about air passenger consumer complaints to the European Consumer Center and have listed several options how to improve the problematic situation.
