Title:UREJANJE DRUŽINSKOPRAVNIH RAZMERIJ PO SMRTI

Abstract:V diplomskem delu je problematika družinskopravnih razmerij po smrti obravnavana v sedmih poglavjih. V zakonskem pravu se problemi pojavljajo v zvezi z razveljavitvijo oziroma razvezo zakonske zveze po smrti enega zakonca, posledice pa so vidne na področju dedovanja, tako zakonitega kot oporočnega. Tudi otroško pravo je soočeno s številnimi dilemami v zvezi z družinskopravnimi instituti priznanja očetovstva, ugotovitve očetovstva in izpodbijanja očetovstva po smrti ali očeta ali otroka. Vse te težave se pojavljajo že vrsto desetletij in večinoma jih ureja Zakon o zakonski zvezi in družinskih razmerjih. Nekaj povsem novega pa so vprašanja glede oploditve z biomedicinsko pomočjo. Z razvojem reprodukcijske tehnike je možna zunajtelesna oploditev, celo zamrznitev jajčnih oziroma semenskih celic ali zarodkov. Vprašanje, ki je zame bistvenega pomena je, ali je tudi pravno dovoljeno vse, kar zmore medicina. Zadnje izmed sedmih poglavij bo namenjeno posthumnim postopkom oploditve z biomedicinsko pomočjo. Vso problematiko bom obravnavala v luči sodnih odločb slovenskih in tujih sodišč ter Sodišča Evropskih skupnosti.

Title:EDITING FAMILY LAW MATTERS AFTER DEATH
Abstract:Diploma thesis deals with the after death family law issues in seven chapters. Matrimonial law problems arise in relation with revocation or divorce after the death of one spouse. The consequences are seen in the succession, both legal and testamentary. Moreover the child law is confronted with numerous dilemmas with reference to family law institutes, like recognition of paternity, ascertainment of paternity and challenge of paternity after death of a father or a child. All these problems already came in sight few decades ago and are largely regulated in Marriage and Family Relations Act. Something new are questions about medically assisted fertilization. With the development of reproductive techniques in vitro fertilization is possible, as well egg freezing, or even freezing of seed cells or embryos. The issue, which is essential for me is, whether it is legally permitted to do everything what medicine can do. The last of seven chapters will be devoted to after death medically assisted fertilization procedures. All issued will be discussed with the reference to judicial decisions of Slovenian and foreign courts and the European Court of Justice.
