Title:PRAVNI IN ETIČNI VIDIK EVTANAZIJE

Abstract:Diplomska naloga predstavlja pravni in etični vidik evtanazije ter kratek pregled stališč v današnjem času in skozi zgodovino. Sama beseda evtanazija je grškega izvora in v dobesednem prevodu pomeni lahko oziroma dobro smrt (eu - dobro, thanatos - smrt). V resnici gre za olajšanje trpljenja ali smrtnega boja umirajočega ali neozdravljivo bolnega na tak način, da umirajoči oziroma neozdravljivo bolni umre. To olajšanje trpljenja ali smrtnega boja je mogoče doseči tako, da bodisi nekaj storimo ali pa opustimo. Pri storitvi gre lahko za aktiven odvzem življenja ali pa za pomoč umirajočemu ali neozdravljivo bolnemu, tako da si ta sam vzame življenje - pomoč pri samomoru (s podajanjem smrtonosnega sredstva umirajočemu). Pri evtanaziji z opustitvijo pa gre za odtegnitev sredstev ali postopkov, ki bi umirajočemu ali neozdravljivo bolnemu utegnili podaljšati življenje. Iz zgodovine lahko razberemo, da se je pojem evtanazije uporabljal za pojmovanje različnih, celo nasprotnih dejstev. Sprva je evtanazija pomenila človekovo željo in hrepenenje po lepi in hitri smrti, brez bolečin in molitev zanjo. Kasneje je pojem evtanazije označeval pozitivno skrb, nego bolnih ter umirajočih in prizadevanje, da bi mogli umreti mirno in po možnosti brez bolečin. V današnjem času pa ta pojem vključuje zraven prvih dveh pojmovanj, neko novo vsebino. Prvotno samo zaželeno mirno in neboleče umiranje, je zdaj načrtovano in uresničeno s predčasnim nasiljem nad življenjem, z umorom iz sočutja. Prvo poglavje diplomske naloge govori o vsebini in pomenu pojma evtanazija ter o vrstah evtanazije. V drugem poglavju je prikazan razvoj evtanazije skozi zgodovino, kako so v različnih obdobjih obravnavali ter različno dojemali pojem evtanazije in izražali različna stališča. Tretje poglavje govori o različnih stališčih do evtanazije, o argumentih za in proti evtanaziji ter o primerih iz sodne prakse (primer Eluana Englaro). V četrtem poglavju je govora o področjih obravnave evtanazije, predvsem o pravnem področju, kako je evtanazija urejena v različnih državah po svetu, v katerih državah je dopustna, kje ne in kako je z zakonodajo na tem področju. Peto poglavje pa se dotika vpogleda v ureditev evtanazije v Sloveniji. Evtanazija tako posega na eno najbolj občutljivih področij človeškega življenja, na področje trpljenja in smrti. Vsak se sooča s starostjo, boleznijo in smrtjo. Še posebej to pride do izraza takrat, ko se v svoji družini srečamo s hudo trpečim sorodnikom. Mnogi si v takšnih situacijah zastavljajo vprašanje, ali ne bi bilo smiselno takšne ljudi odklopiti od aparatov ali pa jim v imenu sočutja in bolezni odvzeti življenje. Takšna stališča so se v zadnjih desetletjih okrepila predvsem na Nizozemskem, v Belgiji, Švici, vse bolj pa se kaže potreba in želje ljudi, da se ta problem uredi tudi v drugih državah, kjer je evtanazija še vedno obravnavana kot uboj (npr. Slovenija).

Title:LEGAL AND ETHICAL ASPECTS OF EUTHANASIA
Abstract:Diploma thesis presents legal and ethical aspects of euthanasia and short summary of views today and throughout history. The word euthanasia is Greek in origin and its literal translation means easy or good death (eu - good, thanatos - death). In fact, it is to facilitate the suffering or death struggle of dying or terminally ill person in such a way that the dying or ill person die. This facilitation can be done to either do something or give up. In service, there can be active deprivation of life or one can help dying or terminally ill person by helping and giving support to commit suicide (by handing lethal medium to dying person). The case of euthanasia by omission is in withholding means or procedures that would prolong life of dying or ill person. From history we notice that the concept of euthanasia was used for understanding different, even conflicting facts. Initially, euthanasia represented human desire and longing for beautiful and quick death, with no pain and prayer for it. Later on, the concept of euthanasia marked positive concern, the care for ill and dying people and the effort to enable them to die peacefully and painlessly. In today's world, this term, beside first two comprehensions, includes a new content. Originally peaceful and painless death is now planned and implemented to the untimely violence and taking life with committing a murder of compassion. The first section of the diploma paper is about the content and meaning of the concept euthanasia and the types of euthanasia. The second section shows the evolution of euthanasia throughout history, how it was dealt in the past and how the notion of it was perceived by various people who had different viewpoints. The third section talks about the different attitudes to euthanasia, the arguments for and against euthanasia and the cases in law practice (e.g. Eluana Englaro). In the fourth section, the treatment of euthanasia in different areas, especially in the area of law, is in question. In particular, how euthanasia is regulated in different countries around the world, in which countries is permissible and where not, and how the legislation is regulated in this area. Section Five give us insight view into the regulation of euthanasia in Slovenia. Euthanasia affects on one of the most sensitive areas of human life, the field of suffering and death. Each human being is confronted with ageing, illness and death. In particular, this comes to the fore when we personally meet with severe suffering relative. In such situations, many raise the question whether it would be more reasonable to disconnect these people from the apparatus or on behalf of compassion and illness deprived their life. Such views have been strengthened in recent decades, particularly in the Netherlands, Belgium and Switzerland. There is also an increasing need and desire to regulate this problem in countries where euthanasia is still considered murder (e.g. Slovenia).
