Abstract:
Javni sektor na različne načine sodeluje z zasebnim sektorjem; ena izmed oblik sodelovanja oziroma povezovanja javnega sektorja z zasebnim pa je javno-zasebno partnerstvo, katerega del je tudi koncesijsko in javnonaročniško razmerje. Poslovno tveganje se je s pomočjo sodne prakse "oblikoval" kot eden izmed najpomembnejših razlikovalnih elementov med koncesijskim in javnonaročniškim razmerjem.

ECONOMIC RISK AS DEFINED ELEMENT OF PUBLIC PROCUREMENT AND PUBLIC PRIVATE PARTNERSHIP IN THE CASE LAW
Abstract:
The public sector cooperates with the private sector in various ways; one of the forms of cooperation or connection of the public and the private sector is the public-private partnership, parts of which are, among others, concession and public procurement. Consequently, the court practice has established economic risk as one of the most important elements of distinguishing between the concession and the public procurement.
