Abstract:Delež storitev v BDP držav je velik in se še povečuje. Prost pretok storitev je ena od štirih temeljnih svobočin prava EU, posebno mesto pa ima tudi v okviru STO. Med tem ko pravo EU storitve, povezane z igrami na srečo ne ureja enotno, pač pa jih urejajo države članice same, pravo STO le-te ne razlikuje od drugih storitev. Načeli nediskriminacije in sorazmernosti sta ureditvama skupni, delno pa to velja tudi za izjeme, ki lahko v določenih primerih prost pretok storitev omejijo. Postopki pred Sodiščem EU in pred organi STO se pomembno razlikujejo v tem, kdo postopek lahko sproži, prav tako pa je razlika tudi glede uveljavljanja odločitve v praksi in sankcij, ki so zagrožene v primeru kršitve predpisov.

Title:FREEDOM TO PROVIDE SERVICES IN LAW OF EU AND WTO
Abstract:The share of services in GDP of countries is large and it is increasing. Free movement of services is one of the four fundamental freedoms in law of EU and has also an important place in the law of WTO. While services related to gambling are not regulated on the unified level of EU law, but by each Member State differently, in the law of the WTO they do not differ from other services. The principles of non-discrimination and proportionality are present in both law of EU and WTO, and in part, this also applies to exceptions that can in certain cases restrict the free movement of services. Procedures before the ECJ and before the WTO's bodies differ in who may initiate the process, as well as in terms of enforcement of decisions in practice and sanctions that are threatened for the violation of the regulations.
