Title:	ZNAMKA IN FIRMA V PRAVU INTELEKTUALNE LASTNINE

Abstract:	Znamko pravno ureja Zakon o industrijski lastnini, ki je tako kot firma, ki je pravno urejena v Zakonu o gospodarskih družbah, pravica industrijske lastnine. Avtorica se v diplomski nalogi ukvarja z vprašanjem razmerja med njima ter navaja možne pravne zahtevke, ki jih ima imetnik prejšnje znamke ali firme proti imetniku kasnejše, enake ali podobne, firme ali znamke. Sprva opredeli teoretične značilnosti firme in znamke ter razlike med njima. Poudarek daje možnim pravnim zahtevkom v pravu industrijske lastnine, ki jih ima imetnik prejšnje pravice, znamke ali firme, v postopku registracije in kasneje v gospodarskem prometu. Na kratko predstavi tudi varstvo znamke in firme v pravu zatiranja nelojalne konkurence in kazenskem pravu. Avtorica ugotavlja, da sama tematika o razmerju med znamko in firmo še zdaleč ni popolno razdelana in zato odpira vrsto vprašanj, na katera praksi do sedaj še ni uspelo podati ustreznih odgovorov. Relevantne sodne odločbe Sodišča Evropske Unije in nacionalnih sodišč avtorici služijo kot pomoč pri boljšem razumevanju same tematike, vendar v omejenem obsegu, saj tudi ta ni preobsežna in dovolj jasna, kar lahko posledično vodi v različne interpretacije.

Title:	TRADEMARK AND COMPANY NAME IN INTELLECTUAL PROPERTY LAW
Abstract:	The trade mark and the company name are industrial property’s legal rights. The trade mark is settled by the Industrial Property Act and the company name is settled by the Companies Act. In this diploma, the authoress deals with the relationship between them and quotes possible law claims, that the owner of the previous trade mark or company name has against the owner of the later, same or similar company name or a trade mark. At first, authoress presents theoretical characteristics of the company name and the trade mark, and the differences between them. The authoress indicates possible law claims of industrial property law, which the owner of the previous right, the company name or the trade mark has, in a procedure of registration and later in the economic market. In a few words authoress briefly presents the protection of the company name and the trade mark within law of unfair competition and criminal law. The authoress concludes that the topic about the relationship between the trade mark and the company name is not perfectly sectioned and therefore reveals more questions, on which the practice does not have answers yet. The relevant case law of the Court of Justice of the European Union and national courts helps the authoress to understand the topic better, but only in limited extent because it is not extensive and define enough, which consequently may result in different interpretations.
