Title:	USTANOVITEV IN FINANCIRANJE NEPROFITNEGA DRUŠTVA

Abstract:	Diplomsko delo je v okviru predmeta Podjetniško pravo. Temelj diplomskega dela bo ustanovitev neprofitnega društva. Na osnovi ustanovitve neprofitnega društva, obdelane teorije in poznavanja zakonov o neprofitnih organizacijah, bomo pričeli z raziskovanjem. Predpostavljamo težak položaj neprofitnih društev glede delovanja, financiranja in prevzemanja odgovornosti ter za to odgovornih članov tekom delovanja. Cilj naloge je ugotoviti, kako vzpostaviti planiranje, vodenje in izvajanje aktivnosti v društvu, da bo le-to čim bolj efektivno ter dobrodošlo za okolje, v katerem deluje in bo imelo prihodnost. Ugotoviti nameravamo, kakšen je tisti pristop, ki bi neprofitno organizacijo pripeljal do stopnje, da lahko deluje sicer svobodno, s svojimi finančnimi sredstvi ter brez osebnostne obremenitve članov, ki jo nosijo zaradi odgovornosti, ki so jo ob določenih trenutkih med delovanjem društva primorani sprejeti. Ugotavljali bomo, kakšen je nasploh pravni položaj društva ter njegovih predstavnikov glede odgovornosti. Raziskovanje bomo podkrepili z dejanskim projektom mladih v občini Lenart. Ustanovili bomo društvo mladih po srcu, ki bo v prid in korist celotnemu okolju. Zaradi samega namena ustanovitve neprofitnih organizacij se bomo ustavili ob vprašanju pomembnosti tovrstnih organizacij v določenem okolju ter primerjali neprofitne organizacije z gospodarskimi družbami in javnimi zavodi. Prav zaradi pomembnosti razlik in sorodnosti na določenih točkah predvidevamo, da bo primerjava podala zanimive rezultate. Ob koncu bomo v raziskovalnem delu preverili podporo ustanovljenemu društvu iz strani pravnih subjektov v okolju, v katerem deluje ter s tem podkrepili opisano teorijo. Diplomsko delo bo potekalo na osnovi ustanovitve Društva »Mladi do kraja«, Lenart, ki nam bo osnova in vzporednica s preostalimi neprofitnimi društvi nasploh.

Title:	ESTABLISHMENT AND PROVIDING FUNDS FOR NONPROFITABLE SOCIETY
Abstract:	This diploma work is based on the subject Company law. The writing will be based on establishing a non-profitable association. We begin the research by establishing a non-profit organization and investigating the theory and the knowledge of their laws. We assume a difficult position regarding the operation of non-profit societies, funding and accountability, and responsible members of this course of action. The aim is to identify the tasks of building up a plan, management and implementation of activities in the association that are most effective and welcome to the environment in which it operates and will have a future in. We intend to find the right approach that leads the non-profit organization to a level in which it can work independently, with its own financial resources and without the personal responsibility of her members who have to take charge in certain times during the operation of the society. We will observe and interpret what is in general the legal position of that kind of society and its representatives about their responsibilities. The research will be supported by an actual project of young people in the municipality of Lenart. We will establish a youth club on which deeds the whole area will benefit. Due to the very purpose of establishing non-profit organization we will stop by asking ourselves about the issue of importance that such organizations give to the environment, and compare non-profit organizations with company’s and public institutions. According to differences and similarities in certain aspects a comparison will give interesting results. In the research part we will check up the support from legal entities in the environment in which it operates and prove further documentation. The diploma will be written on the basis of establishing a Society »Young people till the end", Lenart, which will be paralleled with other non-profit societies in general.
