Title:ODŠKODNINSKOPRAVNO VARSTVO PRAVICE DO OSEBNEGA ŽIVLJENJA IN KOMUNIKACIJSKA ZASEBNOST

Abstract:Diplomska naloga obravnava varstvo pravice do zasebnosti z vidika civilnega prava, kjer se najbolj množično uporablja prav institut denarne odškodnine. Pomemben vidik zasebnosti predstavlja tudi pisemska tajnost, ki pomeni podlago za razvoj modernih načinov komuniciranja, kot je sporazumevanje preko telekomunikacijskih in internetnih omrežij. Tako se je začel že pojem pisem in drugih občil razširjati do te mere, da lahko v sodobnem hitro razvijajočem se tehnološkem napredku pravno zajamemo vse sedanje in bodoče oblike komuniciranja, v katere vdor bo povzročil kršitev pravice do t.i. komunikacijske zasebnosti. Pravica do zasebnosti je ustavno zavarovana človekova pravica, kakor tudi ena izmed temeljnih osebnostnih pravic civilnega prava in je priznana tudi v številnih mednarodnih dokumentih. Enotne definicije za pravico do zasebnosti ni mogoče podati, vzrok temu pa je, da ima vsakdo drugačna pričakovanja glede zasebnosti, pogledi nanjo pa se spreminjajo tudi glede na družbeno okolje, v katerem se osebe gibljejo. Ker je poseganje v to pravico v današnjem času relativno pogosto, je zelo pomembna ureditev njenega varovanja. Pričujoče delo nas tako popelje preko pojma pravice do zasebnosti in ureditve civilnopravnega varstva v drugih najpomembnejših svetovnih pravnih sistemih, kakor tudi v mednarodnem pravu, ki ima po zaslugi sodne prakse Evropskega sodišča za človekove pravice največji vpliv na pravno teorijo in prakso držav članic Sveta Evrope. Zasebnost je torej pomembna predvsem zato, ker ščiti svobodo posameznika ter mu omogoča svobodno odločanje brez posega tretjih, če pa slučajno kdo poseže v njegovo pravico, pa ima ta na voljo razna pravna sredstva, ki mu v določeni situaciji najbolj ustrezajo. Žal je sistem v današnjem svetu narejen tako, da pri ljudeh, ki se jim na kakršnikoli način poseže v zasebnost, najbolj zaleže denarna odškodnina, saj imajo v tem lahko vsaj delno zadoščenje in materialno povračilo za pretrpljene bolečine. Osrednji del naloge zato predstavlja odškodninskopravno varstvo pravice do zasebnosti pri nas, ki je podkrepljeno še s primeri iz slovenske in tuje sodne prakse. Eden izmed aspektov zasebnosti je prav gotovo tudi poseg v zasebna pisanja, katerih neupravičeno prebiranje je lahko razlog za sprožitev civilnopravnega postopka. Dandanes je vse bolj prisoten tudi tako imenovani virtualni svet, ki se je začel razširjati z množično uporabo interneta, kjer je sfera med zasebnim in javnim močno zabrisana. Dostop do podatkov in pošiljanje sporočil je neprimerljivo hitrejše kot v preteklosti, je pa zato veliko bolj nevarno in tvegano, saj omogoča številne nove načine zlorab zasebnosti, zlasti vdor v komunikacijsko zasebnost preko elektronske pošte. Ker je to danes zelo občutljiva tematika, s katero se je praktično srečal že skoraj vsak posameznik, sem drugi del naloge posvetila varstvu komunikacijske zasebnosti in njeni predhodnici, pisemski tajnosti. Ugotavljam, da se v praksi, zahvaljujoč tehnološkemu napredku in s tem poenostavitvi načinov vdora v človekovo zasebnost komunikacij, temeljna pravica do zasebnosti vse pogosteje krši. Tehnološkemu napredku se praktično ni mogoče izogniti, zakaj se mu tudi bi, saj prinaša dobrodošle spremembe in enostavnejšo uporabo na vseh področjih človekovega življenja, vendar pa to ne pomeni, da je treba s tem prezreti temeljne človekove pravice in se obnašati, kot da le-te sploh ne bi nikoli obstajale. Zato menim, da je treba toliko več truda vložiti v zaščito pred vdorom v zasebno življenje.

Title:THE PROTECTION OF PERSONAL RIGHTS IN SLOVENIAN TORT LAW AND THE NOTION OF COMMUNICATIONS PRIVACY
Abstract:In this diploma thesis, I addressed the protection of the right to privacy under civil law, where monetary damages constitute the most frequent form of legal compensation. An important viewpoint of privacy is also the secrecy of correspondence, which is the basis for developing modern ways of communication, such as communicating through telecommunications and internet networks. This is how the notion of letters and other means of communication began to expand to the level that gives ground to legally regulating all contemporary and future forms of communication, stemming from the ever more rapid advancement in technology, in regard to which accessing information without consent causes a violation of rights - the violation of the so-called communications privacy. The right to privacy is a constitutionally protected human right and it also constitutes one of the fundamental personal rights under civil law. As such, it is acknowledged in many international documents. A single definition of the right to privacy cannot be assessed; the reason for it being that everyone has different expectations concerning the notion of privacy, while the perception of the notion of privacy is subject to ever changing aspects affected by the particular social environments individuals have access to. Nowadays, violations of this right are relatively frequent. Therefore, setting up appropriate means to secure its protection is very important. In regard to this, the thesis leads us through the notion of the right to privacy and the regulations in tort law within other highly important legal systems around the globe, and also within the bounds of international law. On account of the legal practice of the European Court of Human Rights, international law has the greatest influence on the legal theory and the legal practice of member states of the Council of Europe. Privacy is important, because it protects the freedom of each individual and guarantees them the freedom of choice without any intervention from a third person. Yet, should it occur that someone’s right concerning this matter would be violated, they have the option of utilizing several different legal remedies, best fitting a specific legal situation. Unfortunately, the system of today is designed in such a manner that people whose privacy had been violated, regard seeking monetary damages as the most suitable option, because monetary damages offer them at least a certain degree of compensation for the emotional distress they had to endure. According to this, the core part of this thesis focuses on the protection of the right to privacy in tort law in Slovenia, backed by examples from Slovenian and foreign legal practice. One of the aspects of privacy is surely the invasion of private letters and unauthorized reading of these can lead to civil actions being taken. Today, the so-called virtual world is more and more present. It has begun to expand with the massive use of the internet where the line between the private and the public is not very clear. Accessing information and sending messages is incomparably faster than it had been in the past, but it is also more dangerous and risky because it enables many new possibilities for violating the privacy, especially for invading the communications privacy via e-mail. Because this topic is very sensitive during recent times and almost every individual has encountered it, I dedicated the second part of this thesis to the protection of the communications privacy and its predecessor, the secrecy of correspondence. I conclude that technological advancement and it setting the basis for implementing easier means of invading the communications privacy, has lead to the fundamental right to privacy being ever more frequently violated in practice. Technological advancement is practically unavoidable, and why should we avoid it since it brings welcome changes and simplifications to all areas of human life.
