Title:POTROŠNIŠKI KREDIT IN OPRAVLJANJE STORITEV POTROŠNIŠKEGA KREDITIRANJA V SLOVENIJI

Abstract:Zadolževanje prebivalstva je do nedavnega bilo zelo aktualno, saj je stanje marsikatere družine tako, da s tekočimi prihodki ne more živeti oziroma si kupiti dobrine večje vrednosti. Zaradi tega se odločajo za najem potrošniških kreditov. Da bi bil potrošnik pri najemu kreditov zaščiten je bil sprejet Zakon o potrošniških kreditih, kateri jasno opredeljuje kaj je tovrstni kredit, kako skleniti pogodbo, kašne so lahko obresti ter sami stroški takega kredita. Podjetja, ki opravljajo tovrstne dejavnosti se morajo določil zakona držati, saj jih lahko ustrezni nadzorni organi kaznujejo z denarnimi kaznimi ali odvzemom dovoljenja. Posredovanje kreditov ne more opravljati vsaka pravna oseba, ampak le tista, ki izpolnjuje kadrovske, tehnične in organizacijske pogoje. Pred oddajo vloge za opravljanje posredovanja kreditov, mora pravna oseba izpolnjevati vse prej omenjene pogoje. Pri izdaji dovoljenja je ministrstvo izredno natančno in upošteva dejansko le popolne vloge, kar je tudi prav, saj le gre za posredovanje denarja. Pri potrošnikih kreditih ima izredno pomembno vlogo tudi Zveza potrošnikov Slovenije, ki si še posebej intenzivno prizadeva za varstvo potrošnikov tudi pred zlorabami ter nepoštenimi praksami pri posredovanju kreditov. Marsikatero podjetje zlorabi stisko ljudi in jim zaračuna visoke oz. večje obresti od dovoljenih. Kljub temu, da je to področje zakonsko dobro urejeno je potrebno razjasniti še marsikatere podrobnosti, predvsem glede obrestne mere ter stroškov kreditiranja.

Title:CONSUMER CREDIT AND PERFORMING OF CONSUMER CREDIT SERVICES IN SLOVENIA
Abstract:The borrowing population has increasingly grown over the last years due to low income that does not provide moderate life or buying expensive goods. Due to that people lease consumer credits. Therefore The Consumer Credit Act was adopted in order to provide consumers with adequate information about consumer credit, mandatory content of the contract, how to ensure effective interest rate (EOM) and actual credit cost. Enterprises that provide consumer credit must follow The Consumer Credit Act in order not to be punished by supervisory authorities with fines or the loss of licence. Legal persons who transmit credits must comply with a condition of staff, technical and organizational conditions. Before handing in a mandatory submission all previously mentioned conditions must be met. When authorising a legal person the Ministry department is careful and accounts only completely correct application. One of the main roles concerning consumer credit plays the Slovenian Consumer Association which intensively strives to protect consumers from abuse and unfair business in credit transmission. Many enterprises abuse the need of people and charge higher interest rates than allowed. Though this field is legally well organised there are still some considerations about interest rates and credit cost to be made. The Slovene legislation adapted itself to the European so there are foreign establishments in the field expected too.
