Abstract:Zaposleni so ključni dejavnik vsakega uspešnega podjetja. Dokler podjetje lahko zaposluje nove kadre se ne pojavljajo večje težave. Te se pojavijo, ko podjetje želi zaposliti, pa za to na domačem trgu delovne sile, ne najde ustreznih kadrov. Tukaj se pojavi vprašanje ali zaposliti tujca ali ne. Tako bodoči zaposleni, kot podjetje, ki išče bodoče kandidate za zasedo delovnega mesta imajo različna pričakovanja in želje, ki jih je potrebno pred pričetkom zaposlitve uskladiti. Kajti načrtovanje in izbira ustreznega kandidata je za podjetje zelo pomembna. Najprej potekajo dejavnosti za iskanje kandidatov v notranjem in zunanjem okolja podjetja. Šele, ko sta ti dve možnosti izčrpani se odločimo za zaposlitev tujca. Zakon ne dopušča vsakemu podjetju, da bi zaposlilo tujca. Omejitve in pogoji so točno določeni in se jim ni mogoče izogniti. Zakonodaja se v času gospodarske krize še zaostruje. Vendar v Sloveniji še vedno obstajajo poklici, ki predstavljajo deficitaren kader in Zavod za zaposlovanje dopušča, da se ta delovna mesta zapolnijo s tujci. Eden od ukrepov za zmanjšanje pritoka tuje delovne sile je tudi centralizacija izdaje delovnih dovoljenj, ki poteka samo v centralni službi Zavoda za zaposlovanje. Dovoljenja na podlagi katerih lahko tujec dela pri nas se razlikujejo glede na dolžino trajanja dela. Najpogosteje se izdaja dovoljenje za namen zaposlitve, ki je v lasti delodajalca in se po preteku dveh let nadgradi v osebno delovno dovoljenje, ki preide v last delavca tujca. Za dejansko delo v Sloveniji pa morajo biti izpolnjeni tudi drugi pogoji kot so: dovoljenje za prebivanje, prijava v invalidsko in socialno zavarovanje, sklenjena pogodba o zaposlitvi.

Title:EMPLOYMENT OF FOREIGNERS IN THE COMPANY VALDIVIA, D.O.O.
Abstract:The employees are the key factor of any successful company. There are no issues, when a company is able to employ new people. Problems appear, when a company wants to employ new people, but does not find suitable candidates on the domestic labour market. This is where the question of whether or not to employ a foreigner comes into play. Future employees and the company searching for future candidates for the work position have different expectations and desires, which have to be determined before employment begins. Planning and selecting a suitable candidate is very important for the company. First, the company looks for the candidate in the internal and external company environment. Only when those two options are exhausted, does the company decide to employ a foreigner. The law does not allow for just any company to employ a foreigner. Limitations and conditions are determined and cannot be avoided. The legislation has become even stricter during the economic crisis. Nevertheless, there are still professions in Slovenia that is regarded as excess in demand; therefore Employment Service of Slovenia allows these work positions to be filled by foreigners. One of the measures to reduce the flow of foreign labour force is centralization of issuing work permits, which is conducted only in the central department of the Employment Service of Slovenia. Permits, allowing a foreigner to work here, differ is regard to the duration of work. Most frequently, the permits are issued for the purpose of the employment and are owned by the employer and can be upgraded to personal work permit after two years and which is owned by the foreigner. The following conditions also have to be met for actual employment in Slovenia: residence permit, application for disability and social insurance, concluded employment contract.
