Title:UPRAVIČENE ODSOTNOSTI Z DELA V SKLADU Z ZAKONOM IN KOLEKTIVNO POGODBO

Abstract:Upravičene odsotnosti z dela predstavljajo eno izmed temeljnih pravic delavca. Med druge upravičene odsotnosti z dela Zakon o delovnih razmerjih uvršča odsotnost, ko delavec ne dela iz razlogov na strani delodajalca, odsotnost z dela zaradi iskanja nove zaposlitve v času odpovednega roka, če odpove pogodbo o zaposlitvi delodajalec, odsotnost zaradi osebnih okoliščin, odsotnost zaradi praznovanja ob praznikih in dela prostih dnevih, odsotnost zaradi zdravstvenih razlogov, odsotnost z dela zaradi uveljavljanja pravic iz invalidskega zavarovanja, odsotnost zaradi opravljanja funkcije ali obveznosti po posebnih zakonih, odsotnost zaradi izobraževanja, odsotnost zaradi izrabe starševskega dopusta, odsotnost z dela zaradi opravljanja sindikalne dejavnosti, ter odsotnost zaradi suspenza pogodbe o zaposlitvi. Delavec ima torej po Zakonu o delovnih razmerjih relativno široke možnosti zaradi katerih je lahko upravičeno odsoten z dela. Upravičene odsotnosti z dela urejajo akti različnih mednarodnih organizacij od Mednarodne organizacije dela do Evropske Unije, ki določajo minimalne standarde, ki jih morajo države podpisnice v svoji notranji zakonodaji upoštevati. Zakon o delovnih razmerjih sledi aktom mednarodnih organizacij in postavlja v svojih določbah minimalne standarde, pri tem pa dopušča možnost ugodnejšega urejanja pravic delavcev in s tem omenjenih institutov v kolektivnih pogodbah in pogodbah o zaposlitvi. Drugačno oz. ugodnejše urejanje upravičenih odsotnosti z dela je pomembno tako s stališča delavca, da regenerira svoje psihofizične sposobnosti in lažje usklajuje svoje poklicne interese z družinskim življenjem, kot s stališča delodajalca, da zagotovi organizacijo in nemoteno delovanje svojega delovnega procesa.

Title:LEGITIMATE ABSENCES FROM WORK IN ACCORDANCE WITH THE ACT OF PARLIAMENT AND COLLECTIVE AGREEMENT
Abstract:Justified absences from work constitute one of the fundamental rights of the worker. Among other eligible absences from work Slovenian Labour Relations Act classifies absence, the employee does not work for reasons on the employer's, absence from work in search of employment, during the notice period to terminate the contract if the employer denounce the contract, absence due to personal circumstances, absence because of celebration public holidays and days not worked, absence due to health reasons, the absence from work due to the exercise of rights under invalidity insurance, the absence because of functions or obligations under the special laws, absence because of education, absence due to parental leave, absence from work due to union action when provided with autonomous norms and the absence of suspension of the employment contract. An employee has regarding Slovenian Labour Relations Act relatively wide range of possibilities which may be entitled to be absent from work, in addition, in case of violation of their rights is also available the institution of justice. Eligible absences from work are also subject of acts of various international organizations from the ILO to the European Community, which set out the minimum standards that must be set by the signatory states in their national legislation into account. Slovenian Labour Relations Act follows the acts of international organizations and places in its provisions minimum standards, while allows the possibility of more favorable regulation of workers' rights and the institutes mentioned in the collective agreements and employment contracts. Different or better regulation of legitimate absences from work is important both from the standpoint of the worker to regenerate his physical and mental capability and better coordinate his professional interests with family life and the employer's point of view that he assures the organization and smooth functioning of his working process.
