Title:REGISTRACIJA MOTORNIH VOZIL S POREKLOM IZ DRUGE DRŽAVE ČLANICE

Abstract:V diplomskem delu je obravnavano področje registracije motornih vozil s poreklom iz druge države članice EU, predvsem v luči novega razlagalnega sporočila Komisije, ki velja od 9. maja 2009 dalje. Pred registracijo v Republiki Sloveniji morajo biti vozila odobrena v skladu s homologacijskimi predpisi, ki so usklajeni s predpisi držav članic EU. Vozila, ki so bila že odobrena in registrirana v kateri od držav članic EU, morajo biti pred registracijo identificirana, kar pomeni, da se tehnični podatki o vozilu zberejo, preverijo in vnesejo v enotno državno podatkovno bazo. Posamična odobritev in identifikacija vozila se izvaja v pooblaščenih kontrolnih organih z izvedbo predpisanega postopka in se zaključi z izdajo potrdila o skladnosti, ki je osnova za registracijo vozila. Kljub temu, da je področje homologacije in registracije vozil v državah članicah že bilo izčrpno urejeno z Razlagalnim sporočilom iz leta 1996, je bil prenos motornega vozila v drugo državo članico še vedno predmet mnogih pritožb, zlasti glede postopkov homologacije in registracije. Z namenom še dodatno olajšati nakup motornega vozila v drugi državi članici, ali prenos motornega vozila v drugo državo članico, je Evropska komisija 24.3.2007 izdala Razlagalno sporočilo o postopkih za registracijo motornih vozil s poreklom iz druge države članice, ki velja od 9. maja 2009 dalje in v katerem so navedena pravila, ki olajšujejo nakup vozila v drugi državi članici. Poleg slednjega pa je bila sprejeta tudi Uredba 764/2008/ES, ki se je začela uporabljati 13. maja 2009. Ta uredba opredeljuje pravice in obveznosti držav članic in podjetij, ki želijo prodajati proizvod, ki se zakonito prodaja v drugi državi članici in je kot takšna prav tako pomembna za uporabo načela prostega pretoka blaga.

Title:REGISTRATION OF MOTOR VEHICLE ORIGINATING FROM OTHER MEMBER STATES
Abstract:This thesis discusses registration of motor vehicle originating from other Member States, especially in light of the new Interpretative Communication, which is in force from 9 May 2009. Prior to registration in the Republic of Slovenia motor vehicles must be approved in accordance with the approval regulations that are consistent with provisions of the Member States. Vehicles that have already been approved and registered in one EU Member State must be identified prior to registration. That means that the technical data is collected on board, checked and entered into a single national database. Individual approval and vehicle identification is carried out in approved inspection bodies. They carry out the whole process, which ends with a certificate of conformity-the basis for registration. Despite the fact that the scope of approval and registration of vehicles in the Member States have already been exhaustively covered by the Interpretative Communication 96 / C 143/04, the transfer of a motor vehicle in another Member State is still the subject of many complaints, particularly as regards approval and registration procedures. In order to further facilitate the purchase of a motor vehicle in another Member State or transfer of a motor vehicle from one Member State to another, the European Commission has issued an Interpretative Communication on procedures for the registration of motor vehicles originating in another Member State, which is in force from 9 May 2009, and in which those rules to facilitate the purchase of a vehicle in another Member State. In addition, the latter was also adopted Regulation 764/2008/ES, which came into force on 13th May 2009. This Regulation sets out the rights and obligations of Member States and companies wishing to sell a product that is lawfully marketed in another Member State, and it is as such also important for the application of the principle of free movement of goods.
