Abstract:Elektronski podpis je posebna metoda podpisovanja, ki temelji na šifriranju. Obstaja veliko tehnoloških postopkov za elektronsko podpisovanje, vendar se razlikujejo glede na stopnjo varnosti in zanesljivosti. Med najbolj razširjene oblike elektronskega podpisovanja spada uporaba kriptografskih metod. Slednje temeljijo na infrastrukturi javnih ključev. Takšna oblika elektronskega podpisa je znana pod imenom digitalni podpis. V diplomskem delu smo obravnavali problematiko elektronskega podpisa, in sicer pretežno s pravnega vidika. Ugotovili smo, da pri elektronskem podpisu prihaja, v primeru zlorabe, velikokrat do problemov identifikacije podpisnika. Namreč, izredno težko je ugotoviti, kdo se je dejansko izdajal za nas, razen če je bil storilec fizično prisoten na našem računalniku in je v sobi recimo nadzorna kamera. Prav tako smo ugotovili, da uporaba elektronskega podpisa ni odvisna od starosti, ampak bolj od računalniške pismenosti. Naše zadnje spoznanje pa se nanaša na tveganje. Slednje je z uporabo elektronskega podpisa občutno manjše kot pri klasičnemu načinu. To trdimo na podlagi dejstva, da do sedaj v Sloveniji še ni bilo primera vdora v napredno kvalificirano digitalno potrdilo.

Title:LEGAL ASPECTS OF ELECTRONIC SIGNATURE RELATED PROBLEMS
Abstract:Electronic signature is a specific method of signing, which is based on encryption. There are many technological procedures for electronic signing, but they differ from the level of security and reliability. The use of cryptographic methods, which are based on public key infrastructure, belongs among the most prevalent forms of electronic signing. This form of electronic signature is known as a digital signature. In this graduate thesis we address the issue of electronic signature, mostly from a legal point of view. What we found out is that, in the case of abuse, there is often hard to identify the signatory. Indeed, it is extremely difficult to determine who actually signed on our behalf, unless the room has, for example, security cameras installed. That is only possible if the offender was physically present on our computer. We also found out that the use of electronic signature is mainly correlated to computer literacy rather than age. Our last observation refers to the risk, which is significantly lower when using electronic signature instead of classical. We make this statement due to the fact that Slovenia has not had a case of intrusion into advanced qualified public key certificate yet.
