Title:NAPOTITEV JAVNIH USLUŽBENCEV V SLOVENSKA DIPLOMATSKA PREDSTAVNIŠTVA IN KONZULATE

Abstract:To diplomsko delo skuša predstaviti javne uslužbence, ki v okviru Ministrstva za zunanje zadeve opravljajo diplomatsko službo v diplomatskih predstavništvih in konzulatih ter njihove pravice in obveznosti, ki se nekoliko razlikujejo od ureditve za ostale javne uslužbence. V diplomskem delu je predstavljen delovnopravni položaj diplomatov, med njimi tudi položaj veleposlanikov, strokovno tehničnih javnih uslužbencev in ostalih javnih uslužbencev, ki so napoteni v diplomatska predstavništva in konzulate na podlagi Zakona o zunanjih zadevah. V delu se ugotavlja specifika postopkov in problemov, tegobe diplomatske službe ter se primerja ureditev skozi zakonodajne spremembe. Diplomsko delo skuša ugotoviti ali sedanja pravna ureditev javnim uslužbencem v diplomatskih predstavništvih in konzulatih zagotavlja dobre pogoje za kvalitetno, predano in učinkovito delo na delovnem mestu ter ali ureditev zagotavlja prijazne razmere tudi za družinske člane, ki z njimi bivajo v tujini. Diplomsko delo analizira organiziranost in delovanje diplomacij v nekaterih državah članicah EU, in sicer na Nizozemskem, Irskem in v Avstriji ter jo primerja z ureditvijo v Sloveniji. Na koncu diplomsko delo predstavi še Evropsko službo za zunanje delovanje in kakšen pomen bo ta imela za slovenske diplomate.

Title:ASSIGNING PUBLIC SERVANTS TO SLOVENIAN DIPLOMATIC MISSIONS AND CONSULAR POSTS
Abstract:This diploma discusses public servants who perform diplomatic service in embassies, permanent representations and consulates of the Ministry of Foreign Affairs and within this framework their rights and obligations that differ from rights and obligations of other public servants. Furthermore, the diploma describes the legal status of diplomats, ambassadors, technical employees and other public servants, who are posted in diplomatic missions and consulates on the basis of Foreign affairs law. It discusses the specificity of procedures and problems diplomatic service is facing and compares the regulation through legal changes. The diploma tries to assess whether current legal regulation enables good conditions for quality, committed and efficient work of diplomats working in diplomatic and consular missions and also, if it assures good circumstances for their family members, who accompany them abroad. Organizational aspects and functioning of diplomatic service in some EU member states, i.e. in the Netherlands, Ireland and Austria, are being analysed and compared with Slovenian one. Also the newly established European External Action Service and its meaning for Slovenian diplomats are discussed in the end
