Title:NETARIFNE OVIRE ZUNANJE TRGOVINE EU

Abstract:V diplomski nalogi z naslovom »Netarifne ovire zunanje trgovine« obravnavam splošna pravila, ki veljajo na področju mednarodne trgovine, in sicer Uredbo o skupnih pravilih za izvoz ter Uredbo o skupnih pravilih za uvoz. Obe uredbi določata kot temeljno načelo prostega pretoka proizvodov, ki je eno od osnovnih načel skupne zunanjetrgovinske politike, zato v prvem delu diplomske naloge na kratko predstavljam skupno zunanjetrgovinsko politiko, ter načela, ki jo definirajo. Nato sledi pregled obsežne sodne prakse, konkretno v zadevah Werner, Leifer, Centro-com, ter Carbone, ki obravnavajo izjeme od načela prostega pretoka proizvodov, tako v okviru' izvozne' kot 'uvozne uredbe'. To je npr. »izjema javnega interesa«, v skladu s katero lahko države članice omejijo prost pretok proizvodov, da ta interes zaščitijo. V skladu s splošnimi pravili uvoza pa lahko EU omeji trgovino tudi z zaščitnimi ukrepi, ki so eden izmed instrumentov trgovinske zaščite, ki jih EU lahko uvede, če podatki o naraščanju uvoza določenega blaga kažejo, da bi takšen uvoz utegnil ogroziti posamezno gospodarsko panogo v EU. Z instrumenti trgovinske politike želi EU zaščititi proizvajalce EU in zagotoviti obstoj gospodarstva EU. Sem sodijo tudi protidumpinške dajatve in izravnalne dajatve, ki imajo pomen zaščitnih mehanizmov v primeru nepoštene trgovine. V diplomski nalogi podrobno predstavljam ureditev obeh trgovinskih obrambnih instrumentov, pogoje za njihovo uvedbo ter postopek, ki je potreben za uresničitev teh ukrepov. Podjetja iz EU pa imajo v primeru nepoštene trgovine še eno možnost, da vplivajo na trgovinske ovire, in sicer pri vstopu na tuje trge tretjih držav in na trgu EU. To jim omogoča Uredba o trgovinskih ovirah (UTO), ki kot pravni instrument daje evropskim podjetjem in gospodarstvu možnost, da odpravijo trgovinske ovire, pri čemer imajo možnost pritožbe. Uporabo UTO, kot instrument trgovinske zaščite, v diplomski nalogi utemeljujem s primeri iz prakse, in sicer primer uporabe UTO, kjer je država, ki je izvajala trgovinsko oviro, zadovoljivo ukrepala ter primer uporabe UTO, kjer država kljub opozorilom Komisije ni ukrepala v smeri odprave trgovinske ovire. V tem primeru se je spor reševal v okviru STO.

Title:Non–tariff barriers to foreign trade
Abstract:In diploma paper, intitled »Non–tariff barriers to foreign trade«, I deal with the general rules applicable to international trade, namely the Regulation on common rules for exports and Regulation on common rules for imports. Both regulations provide a fundamental »principle of free movement of products«, which is one of the basic principles of a common foreign policy, so I am in the first part of the paper briefly presenting a common commercial policy and the principles that define it. Then follows the examination of the extensive case law in case Werner, Leifer, Centro-com and Carbone, that are dealing with exceptions to the principle of free movement of products, both under the 'Export regulation' and 'Import regulation'. This is in example »public interest exception«, according to which Member States may restrict the free movement to protect that interest. In accordance with the general rules on imports, the EU can restrict trade with the safeguards measures, one of the trade defence instrument, which may be imposed by the EU, when analysis on the growth of imports of certain goods show that such imports might jeopardize individual industry in the EU. Trade defence instruments aims to protect European producers. This includes anti-dumping duties and countervailing duties, which are instruments of trade defence in case of unfair trade. In this thesis I am briefly introducing legislation in both the trade defence instruments, the conditions for their introduction and the process that leads to actions carried out in practice. EU companies have in case of unfair trade another option to influence trade barriers in entering foreign markets of third countries and the EU market. This allows them The Trade Barriers Regulation (TBR) as a legal instrument, that gives European business and industry the opportunity to eliminate trade barriers, with a possibility of appeal. In diploma paper I am discussing the use of the TBR in cases, that are implemented in practice.
