Title:UREDITEV STIKOV MED STARŠI IN OTROCI Z VIDIKA VAROVANJA OTROKOVIH KORISTI

Abstract:V diplomski nalogi, ki je pred vami, je predstavljena problematika ureditve stikov med starši in otroci z vidika varovanja otrokovih koristi. Delo je sistematično razdeljeno na različna poglavja, izhodišče diplomske naloge pa predstavljajo razmerja med starši in otroci, znotraj katerih je predstavljena roditeljska pravica, izvrševanje in nadzorstvo nad izvrševanjem le-te. Nadalje sledi poglavje, v katerem je predstavljeno določanje stikov med starši in otroci, kjer je natančno prikazano, kdo ima pravico do stikov, določanje stikov s tretjimi osebami in način, kako se ti stiki določajo. Znotraj tega se pojavljajo različne pristojnosti centra za socialno delo in sodišča, predstavljena je razmejitev med njima, kakor tudi njuno sodelovanje, nenazadnje je predstavljeno tudi sodno izvedenstvo pri odločitvah o dodelitvi otrok v vzgojo in varstvo ter urejanje osebnih stikov. Kot način določanja stikov med starši in otroci, je predstavljena tudi družinska mediacija in primerjalna ureditev družinske mediacije po posameznih evropskih državah. Del poglavja zajema tudi zagovorništvo otroka. Tretje poglavje zajema izvajanje stikov, začasne odredbe in pa izvršitev odločb o osebnih stikih ter izvršitev odločb o prepovedi stikov. Nadalje sledi poglavje o neizvajanju stikov in morebitne sankcije zaradi neizvajanja stikov. V petem poglavju so razdelani ukrepi za varovanje koristi otrok v družinskih postopkih po slovenskem in angleškem pravu. Nenazadnje so predstavljene nekatere konvencije, ki urejajo predmetno zadevo. Delo zavzema družinskopravno ureditev, pomeni, da so uporabljeni predvsem zakoni s področja družinskega varstva, prav tako pa tudi konvencije, ki ščitijo pravice in koristi otroka. Seveda so skozi celotno diplomsko nalogo poleg teorije predstavljeni tudi različni primeri iz sodne prakse.

Title:REGULATION OF CONTACTS BETWEEN PARENTS AND CHILDREN FROM THE STANDPOINT OF THE CHILD'S BENEFITS PROTECTION
Abstract:In this thesis which is in front of you are presented problems of regulation of contacts between parents and children from the standpoint of the child’s benefits protection. Thesis is systematically divided into different chapters, starting point of this thesis represent relationship between parents and children within which is presented parental rights, enforcement and supervision over the implementation of it. Furthermore, the following section presents regulation of contacts between parents and children, where is presented exactly who has the right to contact and determinating contacts with third parties and how are these contacts provided. Inside this chapter are presented various powers of the Centre for Social Work and Court, the distinction between them as well as their participation, at last but not least chapter presents expert opinion when deciding about regulation of contacts between parents and children. As a way of regulation of contacts between parents and children is presented family mediation and family mediation comparative legislation in individual European countries. Part of the chapter also includes a child advocacy. The third section covers the implementation of contacts, interim measures and the enforcement of decisions about personal relationships as well as decisions about prohibition enforcement contacts. Furthermore, the following chapter is about failure to carry out contacts and potential sanctions for failure to contact. The fifth chapter elaborated measures to protect the interests of children in family proceedings under the Slovenian and English law. At the end are present some conventions governing the present case. It contains family legal systems meaning that are used primarily in the area of family law protection, as well as conventions that protect the rights and benefits of the child. Of course, throughout the thesis in addition to the theory presented with examples from cases of family law.
