Title:DOHODNINA V EU S POUDARKOM NA KLJUČNIH SEGMENTIH

Abstract:V času, ko so države članice EU vse bolj povezane, hkrati pa se število članic še vedno povečuje, so zakonske ureditve posameznih držav veliko pomembnejše za ostale članice. Kljub mednarodnim aktom, ki veljajo za večino držav članic, so določene veje prava še vedno v rokah posamezne države. Eno izmed takšnih področij je tudi dohodnina oz. davčno pravo. Diplomsko delo v prvem poglavju opredeljuje dohodnino na splošno. Na kratko so pojasnjene temeljne sestavine dohodnine, njen razvoj in pomembne točke, tako glede zakonske ureditve, kot tudi pomembnosti v mednarodnem elementu. V drugem poglavju je predstavljena dohodnina za vsako državo članico EU posebej, poudarek pa je predvsem na ključnih elementih. Na kratko je predstavljena dohodnina na splošno, podana je tako pravna podlaga dohodnine, kot tudi veja oblasti, ki določa posamezne določbe glede dohodnine. Predstavljene so zakonske določbe glede zavezancev za dohodnino, ki so od države do države različno obsežno opredeljeni. V tretjem podpoglavju vsake države je natančno opredeljen predmet dohodnine, opisani pa so tudi posamezni viri dohodkov, ki spadajo v dohodnino oz. so iz nje izključeni. Za vsako državo članico so za predmetom obdavčitve podane še davčne olajšave oz. oprostitve, sledijo pa jim morebitne posebnosti v posamezni državi. V predzadnjem podpoglavju vsake države je predstavljena še dohodninska lestvica, v zadnjem podpoglavju pa so zbrani statistični podatki plačane dohodnine po letih, ali večih davkov, ki skupaj tvorijo dohodnino oz. davek na osebni dohodek. Tretje poglavje vsebuje strnjen primerjalni pregled dohodnin v EU, kjer so med seboj primerjane določbe glede dohodnin posameznih držav, na kratko pa so pojasnjene tudi pozitivne in negativne določbe posamezne države. V sklepu bom poskušal kar najbolj objektivno poiskati najboljšo kombinacijo določb posameznih držav in iz njih sestaviti optimalne dohodninske določbe.

Title:PERSONAL INCOME TAX IN EU WITH STRESS ON KEY ELEMENTS
Abstract:In times, when EU countries are increasingly connected and the number of members is growing, each country's legislation is even more important for the others than before. Despite the international acts, that are mandatory for most of the EU members, certain branches of law are still regulated by each country individually. One of those branches is personal income tax or tax law as a whole. In the first chapter the study defines overall personal income tax. It explains the fundamental components of personal income tax, its development and important components in legislation, as well as its importance in international element. Second chapter presents personal income tax for each EU member, with key elements stressed. Personal income tax is presented as overall, as well as its legal basis and the authority that sets the tax regulation. The study presents legal basis for the taxpayer, who is determined differently for each country. Third subchapters of respective countries precisely determine the object of personal income tax and describe income sources that are included or excluded from personal income tax. After tax object, the study lists tax reliefs and exemptions, and possible special features for each country. Before last subchapter the study deliveres tax rate, and in last chapter there is statistical information of paid personal income tax for each year. Third chapter contains short comparison of personal income tax legislations of EU members and certain positive and negative law provisions. In conclusion I tried to find the best combination of provisions from EU members about personal income tax and compose the most optimal provisions of personal income tax.
