Title:ELEKTRONSKO VLAGANJE ZEMLJIŠKOKNJIŽNIH PREDLOGOV

Abstract:Zakon o zemljiški knjigi (ZZK-1) je pravni predpis, ki določa jasna pravila glede organizacijske strukture zemljiške knjige ter pravila glede pravnih učinkov vpisovanja pravic in pravnih dejstev na nepremičninah v zemljiško knjigo. Prav zaradi pomembnosti zemljiške knjige, kot javnega registra v diplomskem delu predstavljam prihajajočo ureditev, ki bo dopolnila in spremenila Zakon o zemljiški knjigi (novela ZZK-1C). Novela zakona uvaja celovito informatizacijo vseh procesov, povezanih z odločanjem o vpisih, uvaja pa se tudi informatizirana zbirka listin. Eden od pomembnejših ciljev predloga novele je znižanje časovnega obdobja in poenostavitev zadnje in pravno najpomembnejše faze poslovanja z nepremičninami — vpisa v zemljiško knjigo, zato bo po novi ureditvi obvezna elektronska vložitev zemljiškoknjižnega predloga. Uvedba predlaganih sprememb in informatizacija sistema bosta omogočili zmanjšanje deleža nepopolnih zemljiškoknjižnih predlogov, hitrejše odločanje v postopkih zemljiškoknjižnih vpisov, večjo učinkovitost sodstva zaradi novega dodeljevanja zadev v reševanje in hkrati enakomerno obremenjenost zemljiškoknjižnih sodišč.

Title:ELECTRONIC LAND REGISTER PROPOSAL
Abstract:Land registry act (ZZK-1) is a legislative act, which sets out clear rules regarding the organizational structure of the land registry and rules of the legal effects of registration of rights and legal facts on real estate in the land register. Because of the importance of the land registry, as a public register, in my diploma paper I will present the upcoming legislation, which will supplement and change Land registry act (novel ZZK-1C). The novel of the act establishes a complete computerization of all processes, associated with entry of rights and legal facts into land register, and also establishes a computerized collection of documents. One of the important goals of the novel is the reduction of the time period and simplifying the latest and most important phase of business with real estate – entries in the land register therefore it will be, by the upcoming legislation, mandatory to put in an electronic land register proposal. The introduction of the proposed changes and the computerization of the system will make it possible to reduce the proportion of incomplete land register proposals, faster decision-making processes of land registry entries, grater efficiency of the judiciary because of the new allocation of cases and at the same time land registry courts will be equally burdened.
