Title:VPLIV PONAREJANJA IN PIRATSTVA NA TRG EVROPSKE UNIJE

Abstract:Trgovina s ponaredki je čedalje večji svetovni problem. Po več kot tridesetih letih se je ponarejanje in piratstvo spremenilo, postalo obsežnejše, agresivnejše in vplivnejše kot pred leti. Na trgu EU narašča količina ponarejenih izdelkov za široko potrošnjo, kot so raznorazna oblačila, hrana, pijača, cigarete, otroške igrače, zdravila idr. Organi EU zasežejo vedno več ponaredkov, ki skuša priti na trg in beležijo vedno več primerov suma kršitve pravic intelektualne lastnine. Vpliv čutijo potrošniki, podjetja kot imetniki pravic intelektualne lastnine in gospodarstvo države. Posledica so družbeno gospodarski vplivi, ki se odražajo v manjši gospodarski rasti zaradi zmanjšanih investicij, vplivu na okolje, zmanjšanju števila delovnih mest in ogrožanju neposrednih tujih investicij in mednarodne trgovine. Zaradi ponaredkov podjetja izgubljajo zaupanje in ugled, ki so si ga pridobili z dolgoletno rastjo in razvojem podjetja. Nekatera podjetja opažajo zmanjšanje prodaje in padec dobička. Blagovna znamka izgublja na vrednosti, še posebej pri tistih kupcih, ki se ne zavedajo, da kupujejo ponaredke. Zdravje in varnost potrošnikov so ogrožena, ker ponaredki vsebujejo nevarne snovi in ne izpolnjujejo varnostnih standardov. Ponarejanje pritiska tudi na državni proračun, saj država pobere manj davkov, carinskih dajatev stroškov boja proti ponaredkom. Evropska unija si močno prizadeva, da bo preprečila ponarejanja in piratstva s sprejemanjem posebnih programov, odpiranjem uradov, sklepanjem sporazumov in sprejemanjem in učinkovitim uveljavljanjem zakonodaje na področju intelektualne lastnine. Pomembna postaja krepitev sodelovanja z državami, ki so pomembne trgovske partnerice, na področju prava, gospodarstva in carinskega sodelovanja. Na slovenskem trgu ponarejanje ni tako obsežno kot ga predstavlja na trgu držav vzhodne in jugovzhodne Evrope. Slovenija je bolj znana kot tranzitna država, saj je veliko ponaredkov zaseženih v Luki Koper, ki so pretežno namenjeni na trg zahodnih in srednjih držav EU.

Title:THE IMPACT OF COUNTERFEITING AND PIRACY ON EU MARKET
Abstract:Trade in counterfeits is becoming growing global problem. After more than thirty years, counterfeiting and piracy has changed and became larger, more aggressive and sophisticated. The amount of counterfeits on the EU market, such as clothing, food, drink, cigarettes, children's toys and medicines is increasing. EU customs authorities seize more and more counterfeits at the European border every year and they are trying to prevent them from entering on the EU market. The number of cases of suspected infringement of intellectual property is also increasing every year. Counterfeiting is affecting consumers, businesses as intellectual property rights holders, and government on many ways. It causes socio-economic effects, such as lower economic growth due to reduced investment; it has impact on the environment, employment, and could have effect on foreign direct investment and international trade. Companies are losing reputation, image and consumer confidence, which they have gained during company’s growth. Companies affected by counterfeiting and piracy suffer a direct loss in sales volume and loss of profits. The presence of counterfeit products may damage the value of the brand, especially among those buyers, who are unaware that they are buying fakes. Consumer health and safety are threatened because counterfeits contain hazardous substances and do not meet security standards. There is also pressure on state budget due to various tax losses, loss of custom duties and additional costs associated with fighting counterfeiting and piracy. The European Union is strongly committed to reduce counterfeiting and piracy with the adoption of specific programs, with opening new offices, signing new agreements and effective enforcement of legislation on intellectual property. It is important to strengthen cooperation with EU top trading partners on legal and economic field and to perform custom cooperation activities. Counterfeiting on the Slovenian market is not as extensive as it is on Eastern and Southeastern European market. Slovenia is more known as a transit country because many of the counterfeits that are seized at Luka Koper are mainly destined for the market of West and Central Europe.
