Title:NEREGISTRIRAN MODEL EU KOT NOVEJŠA PRAVICA INTELEKTUALNE LASTNINE

Abstract:Neregistriran model EU kot novejša pravica intelektualne lastnine je bil uveden v sistem unitarnih pravic EU z Uredbo 6/2002. Avtorica v diplomskem delu obravnava neregistriran model EU ter določa njegove razsežnosti in omejitve glede na že obstoječe pravice intelektualne lastnine. Skozi diplomsko delo avtorica ugotavlja, da neregistriran model EU sledi potrebam prakse že od samega začetka. Namen uvedbe neregistriranega modela EU je v tem, da se videzom izdelka, ki se proizvajajo v velikih količinah in ki tržno trajajo kratek čas podeli varstvo primerno njihovi pomembnosti. Neregistriran model EU zagotavlja varstvo videzu izdelka neposredno in avtomatično od prvega razkritja javnosti. Za njegovo pridobitev se ne zahteva vložitev prijave in plačila pristojbin. Poudarek daje celoviti predstavitvi neregistriranega modela EU in njegovi primerjavi z registriranim modelom EU, britanskim neregistriranim modelom in avtorsko pravico. Na kratko predstavi tudi vzroke za uvedbo unitarne pravice na področju pravnega varstva modelov in postopek sprejemanja Uredbe 6/2002. Avtorica ugotavlja, da kljub ureditvi bistvenih elementov neregistriranega modela EU v Uredbi 6/2002 ostaja veliko odprtih vprašanj, na katere praksi do sedaj še ni uspelo podati ustreznih odgovorov. Sodišče EU je v primeru neregistriranega modela EU odločalo samo v eni zadevi, v vseh ostalih so odločala specializirana nacionalna sodišča za model EU.

Title:UNREGISTERED COMMUNITY DESIGN AS A NEW INTELLECTUAL PROPERTY RIGHT
Abstract:Unregistered Community Design as the new intellectual property right was introduced into EU Unitarian system of rights with Council Regulation (EC) No 6/2002. The authoress of this diploma thesis discusses the Unregistered Community Design, its dimensions and restrictions according to the existing intellectual property rights. The authoress states that Unregistered Community Design has been developed for the practical use since its establishment. The function of Unregistered Community Design is to provide certain requirements for protection for the product's appearance. This concerns the products that are manufactured in big quantities and have short duration on the market. Unregistered Community Design ensures the protection of product's appearance – directly and automatically from the date on which the design has first been made available to the public. To acquire the protection, no application or fee payments are required. The diploma gives an emphasis on the complete presentation of Unregistered Community Design and on the comparison between Unregistered Community Design and Registered Community Design, UK unregistered design and copyright. The thesis provides a brief overview of the causes for the establishment of unitarian right in the field of product protection and the procedure of introducing and enacting the Council Regulation (EC) No 6/2002. The authoress states that, irrespective of the establishment of the most essential elements of Unregistered Community Design in Council Regulation (EC) No 6/2002, there exist quite a few unanswered questions. In the case of Unregistered Community Design, the Court of the European Union so far decided upon one matter only, while specialized national courts for Community Design decided upon all other matters.
