Title:POKLICNA MOLČEČNOST V ZDRAVSTVU

Abstract:Zdravnik se pri srečanju s pacientom seznani z mnogimi intimnimi in zasebnimi podatki pacienta, za katere pacient upravičeno pričakuje, da ne bodo zapustili ordinacije. Za učinkovit proces zdravljenja je potrebno medsebojno zaupanje med pacientom in zdravnikom. Dolžnost varovati poklicno skrivnost je določena tako s Kodeksom medicinske deontologije Slovenije, kot tudi s številnimi zakoni, kot so Zakon o pacientovih pravicah, Kazenski zakonik, Zakon o zdravniški službi itd., velja pa tako za zdravnike, kot tudi za preostalo zdravstveno osebje. Za poklicno skrivnost se štejejo vsi podatki, ki jih zdravnik pridobi zaradi narave njegovega dela. Sem štejemo vse podatke o pacientu, še posebej podatke o njegovem zdravstvenem stanju, osebnih, družinskih in socialnih razmerah ter seveda tudi informacije v zvezi z ugotavljanjem, zdravljenjem in spremljanjem bolezni in poškodb. Dolžnost zdravniške molčečnosti je eden izmed vidikov pravice do zasebnosti, ki pa je ena izmed pomembnejših osnovnih človekovih pravic. Pravica do zasebnosti je urejena z mnogimi mednarodnimi pravnimi akti, ki veljajo tudi pri nas. Poleg teh mednarodnih aktov pa je pravica do zasebnosti v Sloveniji urejena tudi s 35. členom ustave. Naša zakonodaja je eno od pravic zasebnosti, varstvo zasebnih podatkov, zavarovala še s posebnim zakonom (zakon o varstvu osebnih podatkov). V skladu z obravnavano tematiko je tako predstavljen pojem in razvoj osnovnih človekovih pravic in svoboščin, pravice do zasebnosti in konkretneje pravice do zasebnosti v medicini. Podrobneje je predstavljena zdravniška skrivnost kot vidik pravice do zasebnosti — od zgodovinskega pogleda, pravne podlage, do omejitve zdravniške molčečnosti, načinov, posledic izdaje in procesnopravnih problemov, predstavljena pa je tudi ureditev zdravniške molečečnosti v Veliki Britaniji, Združenih državah Amerike in na Irskem.

Title:CONFIDENTIALITY IN HEALTHCARE
Abstract:Physician gets acquainted with much of intimate and private data of a pacient, for which the patient is entitled to expect for not leaving the examination room. Mutual trust between patient and a physician is needed for treatment process to be effective. The duty of professional secrecy is determined by the Code of Medical Deontology of Slovenia, as well as with many acts, such as the Patients Rights Act, the Penal Code, General Practitioner Services Act, etc.. and they are valid also for doctors, as well as for the rest of the medical staff. Professional secrecy includes all information obtained by the doctor because of the nature of his work. Included are full details of the patient, particularly information about his medical condition, personal, family and social situation and of course the information relating to the identification, treatment and monitoring of diseases and injuries. The duty of medical confidentiality is one aspect of the right to privacy, which is one of the most important basic human rights. The right to privacy is governed by numerous international legal instruments, which are also in force in our country. In addition to these international instruments, the right to privacy is also regulated in Slovenia with the 35th Article of the Constitution. Our legislation has one of privacy rights, protection of private information, secured by a special act (Data Protection Act). In accordance with the subject matter is so presented the concept and development of basic human rights and freedoms, privacy rights and specifically the right to privacy in health care. Medical confidentiality is in detail presented as an aspect of the right to privacy - from the historical view, the legal basis, to restrictions, methods, consequences of breaching confidentiality and procedural problems, presented is also regulation of medical confidentiality in Great Britain, United States of America and Ireland.
