Title:ZAKONSKI OKVIRI IZOBRAŽEVANJA ROMSKIH OTROK

Abstract:Ustava Republike Slovenije določa, da položaj in posebne pravice romske skupnosti, ki živi v Sloveniji, ureja zakon. S to ustavno določbo so možnosti, ki vključujejo sprejem posebnih zakonskih določb ali vladnih ukrepov za izboljšanje položaja vseh Romov, ki živijo v Sloveniji, le nakazane. Določbe o pravnem varstvu posebnih pravic Romov v Sloveniji so zajete v 14 področnih zakonih. V letu 2007 je bil sprejet Zakon o romski skupnosti v Sloveniji, ki ureja vprašanja organiziranosti Romov na lokalni in nacionalni ravni. Romska skupnost se tako v Sloveniji kot v drugih evropskih državah srečuje s problemi brezposelnosti, neurejenimi stanovanjskimi in drugimi življenjskimi pogoji, predvsem pa z nizko izobrazbeno strukturo Romov. Tako v Sloveniji kot drugod po svetu se problematika romske skupnosti najbolj kaže v brezposlenosti, slabih življenjskih pogojih, nizki izobrazbeni strukturi… Najnovejše raziskave in razne strategije, ki se izvajajo z namenom izboljšanja življenjskih pogojev in hitrejši ter lažji asimilaciji, vse bolj upoštevajo kulturno, jezikovno in zgodovinsko raznolikost. Kar se kaže tudi v zakonodaji, še posebej na področju izobraževanja. Posebne potrebe šoloobveznih romskih otrok narekujejo tudi temu primerne prilagoditve. Zakonodaja je na tem področju dokaj fleksibilna in omogoča tako možnost oblikovanja oddelkov zgolj z romskimi otroki ali mešane oddelke, kjer romski otroci obiskujejo pouk skupaj z ostalimi neromskimi otroci. Vse več se povdarja integriranost romskih otrok v zgodnji dobi izobraževanja, tako pred samim vstopom, kot tudi kasneje, v prvih štirih razredih. V začetnem obdobju rabijo največ pomoči, ta se vse bolj izvaja v obliki romskih pomočnikov. V RS področje vzgoje in izobraževanja romske skupnosti poleg ostalih področnih zakonov ureja predvsem Zakon o osnovni šoli, ki daje pravno podlago podzakonskemu urejanju. Zakonodaja je na omenjenem področju dokaj skopa, zato prepušča pravno ureditev predvsem podzakonskemu urejanju. Z uvedbo Strategije vzgoje in izobraževanja Romov v RS leta 2004, pri kateri je poleg strokovnjakov Ministrstva za šolstvo in šport ter Zavoda RS za šolstvo sodelovala tudi Zveza Romov Slovenije, so se na področju podzakonskega urejanja na področju vzgoje in izobraževanja romske skupnosti pričele bistvene spremembe, ki se v praksi po podatkih Ministrstva za šolstvo in šport že kažejo v izboljšanju izobrazbene strukture romske skupnosti. Problem razvrščanja romskih otrok v osnovne šole s prilagojenim progamom na podlagi šolske neuspešnosti, ki izvira iz jezika ali specifičnosti romske kulture, pa tudi s prenovljeno strategijo še vedno ni v celoti odpravljeno.

Title:LAW PERSPECTIVE IN EDUCATION OF ROMA CHILDREN
Abstract:SUMMARY The Constitution of the Republic of Slovenia stipulates that the status and special rights of the Romany community living in Slovenia are determined by a statue (Article 65). This constitutional provision has been implemented through provision of different laws. The special Roma law was prepared in 2007. As in other countries, the major problems of Roma in Slovenia are unemployment, housing and bad living conditions and their low level of education. Only some recent developments in the past decade have taken into account cultural, linguistic, and historical features of Roma in the field of their education. The key issue is how to establish the best methods to enable Romany children to be included in the educational programmes in kindergartens and how to carry out forms of education that promote their socialization. Regulations in the fields of education and training take into account the specific needs of Romany children in different organizational types of education: only Romany classes in which Romany children are included within the mixed ethnic population. It is especially important for Romany pupils in the first four grades of the primary school to have adequate support and help when needed, for example roman assistant. The main problem is the lack of qualified teaching personnel with a good command of the Romany language and that a great number of Roma children are still excluded from regular forms of education. The Primary School Act besides others sectoral acts, which provides the legal basis of implementing regulations, handles the education of the Roma community. The legislation in this area is somewhat lacking as the legislation act. By introducing the 2004 Roma Community Strategy in the Republic of Slovenia, which brings together and promotes cooperation of experts from the Ministry of education and Sports, the National Education Institute and the Roma Association, major changes were initiated within implementing regulations in the field of Roma community education, which have already brought improvements in the educational structure of the Roma community according to data from the Ministry of Education and Sports. The problem of classifying Roma children to primary schools with adapted programmes on the basis of academic inefficiency, which originate from the lack of language knowledge or the specific nature of the Roma culture, has yet to be completely abolished even with the renewed strategy.
