Title:ZLORABA PREVLADUJOČEGA POLOŽAJA NA TRGU GOVORNE TELEFONIJE - analiza odločbe UVK v primeru Telekom

Abstract:Zlorabo prevladujočega položaja ureja Zakon o preprečevanju omejevanja konkurence in je ena izmed treh oblik podjetniškega omejevanja konkurence. Avtorica se v diplomski nalogi ukvarja z vprašanjem prevladujočega položaja in zlorabe tega položaja v konkretnem primeru zlorabe prevladujočega položaja s strani Telekoma. Na začetku diplomske naloge avtorica poda analizo obravnavanega primera zlorabe iz leta 1997, kjer je bila s strani Urada Republike Slovenije za varstvo konkurence, ugotovljena zloraba prevladujočega položaja s strani Telekoma z zavrnitvijo dobave in bojkotom podjetij K2.net in Quantum, v nadaljevanju pa opredeljuje prevladujoči položaj in elemente zlorabe prevladujočega položaja. Avtorica ugotavlja, da je Telekom z diskriminacijo konkurenčnih podjetij in posledično dajanjem prednosti lastnemu sistemu SiOL na način, da je le slednjemu omogočil uporabo cenejše številke za dostop do interneta, zlorabil svoj prevladujoč položaj. Zadeva, katero avtorica obravnava, sega v leto 1997 in je prvi primer odločbe Urada za varstvo konkurence o zlorabi prevladujočega položaja.

Title:ABUSE OF DOMINANT POSITION IN TELECOMMUNICATION MARKET - THE TELECOM DECISION
Abstract:Prevention of the restriction of competition act (PRCA-1) regulates prohibition of the abuse of a dominant position in Slovenia. The abuse of a dominant position is one of three forms of entrepreneurial restriction of competition. The authorees of this thesis deals with the question of dominance and abuse of that position in the specific case of abuse of dominant position by Telecom. At the beginning of this work authoress gives an analysis of actual case of abuse in 1997, where it was by the Office of the Republic of Slovenia for Protection of Competition, found abuse of dominant position by refusing to supply and to boycott companies K2. net and Quantum by Telecom, continued by defining dominant position and features of abuse of dominant position, focus and gives an analysis The authoress notes that by discriminating Telecom competitors and favouring their own system SiOL in a way that only SiOL was allowed to use cheaper numbers to access the Internet, means that Telecom abused its dominant position. The case, which the authoress discusses, dates back to 1997 and is the first decision of the Office for Protection of Competition on abuse of dominance.
