Title:PRAVICE OTROK DO STIKOV S TRETJIMI OSEBAMI

Abstract:S pomočjo instituta stika otrok s tretjimi osebami skušamo preprečiti škodljive in nezaželjene odtujitve otroka od njemu bližnjih oseb. Kot takšne osebe se tretitajo babica in dedek, (pol)brat in (pol)sestra, prejšnji in sedanji zakonec oz. zunajzakonski partner enega ali drugega izmed njegovih staršev in nekdanji rejniki. Krog teh ljudi pa s tem ni zaključen. Ob izpolnitvi pogoja navezanosti in varovanja otrokove koristi lahko pravica do stikov zajame še kakšno osebo, ki v zakonu ni omenjena. Gre torej za osebe s katerimi je otrok v določeni tesnejši povezanosti in med katerimi se prepletajo številni pristni in ljubeči odnosi, ki predstavljajo tako za otroka, kot tudi tretjo osebo pomemben košček življenja. Primarno vlogo v življenja otroka igrajo starši, kljub temu pa ne smemo pozabiti na osebe, ki otroku zraven staršev ali celo namesto njih nudijo vse potrebno za njihov uspešen osebnostni razvoj. Otrokova korist je torej tisti ključni element, ki pogojuje dovolitev stikov otroka s tretjo osebo. O otrokovih stikih na prvi stopnji odločajo sodišča v pravdnem postopku, kadar se le ti rešujejo skupaj s spori o varstvu in vzgoji otrok, drugače pa v nepravdnem postopku. Zraven določitve upravičencev do stikov otroka s tretjimi je ravno tako pomembna možnost dejanske izvršitve pravice, saj drugače lahko govorimo le o pravici na papirju in ne v življenju. Pravice do stikov nam nihče ne more odvzeti, kadar pa nam kdo vanjo neupravičeno posega ali s strani države ali posameznika, pa imamo pravico do uporabe odškodninskega zahtevka.

Title:CHILDREN'S RIGHTS OF CONTACT TO THIRD PARTIES
Abstract:Children’s rights of contact to third parties is the institute that helps us to prevent harmful and undesirable disposal if the children from their loved ones. Such persons are known as grandmother and grandfather, (half) brother and (half) sister, ex and current spouse or. cohabiting partner of one or other of his parents, former foster parents. The circle of these people doesn’t end with that, if there is an fulfilled condition of attachment and the protection of child's interests we can also include in this circle a particular person that the law doesn’t lists as such. Those are the people that are in contact with the child in form of close connection and among which there is a number of genuine and loving relationships that present to a child and to certain other a significant piece in life. The primary role in child’s life belongs to parents, but we can’t ignore the role that belongs to people that beside the parents or instead of them take care of the child and their personal development. Child's interests as such are the key element which makes contact of a child to third party allowing. The decision concerning the children's contact is made by the first instance court in civil proceedings, but only when those disputes resolve with the disputes concerning the protection and upbringing of a child, otherwise they are resolved in a non-litigious proceedings. Besides determining the beneficiaries of children’s rights of contact to third parties is just as important a proper enforcement of rights, since otherwise we can only speak on the right on paper and not in life. No one can take us away our right of contact, but when there is unjustified interference of a state or of an individual, we have a right to claim damages.
