Title:MEJE KONTINUITETE UPORABE KOORDINACIJSKIH PRAVIL O SOCIALNI VARNOSTI V EU IN NADALJNJI RAZVOJ EVROPSKEGA SISTEMA SOCIALNE VARNOSTI

Abstract:V okviru prava socialne varnosti Evropske unije je s 01.05.2010 začela veljati nova uredbena ureditev koordinacije sistemov socialne varnosti. V magistrski nalogi je z vidika nadaljnje uporabe (novih) koordinacijskih pravil, ki so tesno povezana s svoboščino prostega gibanja ljudi, predstavljena analiza primerjalno-pravnega pregleda stare in nove ureditve. Z vidika kontinuitete oziroma nadaljnjega razvoja evropskega sistema socialne varnosti pa so v nalogi izpostavljena predvsem odprta vprašanja, sodna praksa Sodišča Evropske unije in problematika modernizacije enotnega evropskega sistema socialne varnosti. Nova uredbena ureditev koordinacije sistemov socialne varnosti, katere glavno vodilo je še vedno zagotavljanje in vzpodbujanje svobode gibanja ljudi, z vsebinskega vidika večjih sprememb ne prinaša. Temeljna pravila se ohranjajo in namen koordinacije je še vedno povezovanje sistemov socialne varnosti, brez njihovega poenotenja (harmonizacije). Glavna cilja nove ureditve sta poenostavitev in modernizacija. Pomembne so tudi nekatere »tehnične« spremembe (»administrativni« napredek) in novosti glede postopkov odločanja o socialnih pravicah, kar posledično zagotavlja višjo stopnjo varstva pravic. Koordinacija sistemov socialne varnosti svojo materialno veljavnost (ki je »zgolj« dopolnjena z dajatvami iz naslova očetovstva in pred-upokojitvenimi pravicami) ohranja, ter novih »samostojnih« pravic ne prinaša, pa čeprav je Sodišče Evropske unije v svojih sodbah že večkrat opozorilo na nekatere pravice oziroma dajatve in storitve, ki bi prav tako morale biti predmet koordinacije (pravice iz naslova dolgotrajne oskrbe, zdravstvene storitve in dajatve za tiste, ki jim brezposelnost šele grozi). Za kontinuiteto uporabe koordinacijskih pravil (kot tudi za nadaljnji razvoj evropskega sistema/prava socialne varnosti) je pomembna »nova« širša osebna veljavnost nove koordinacijske uredbe, saj le-ta vključuje vse državljane Evropske unije, tako ekonomsko aktivne kot tudi neaktivne. V posledici navedenega so tako v novi ureditvi povzdignjene določbe evropskega državljanstva, socialna solidarnost in temeljna načela koordinacije sistemov socialne varnosti (predvsem teritorialno načelo in načelo enakega obravnavanja). Načela evropske koordinacije so tudi v splošnem z novo uredbo nadgrajena in njihova vloga je okrepljena. Številna koordinacijska pravila so posodobljena, preglednejša, enostavnejša, transparentnejša in bolje strukturirana ter posledično za upravičence/zavarovance (katerim so ta pravila tudi dejansko namenjena) lažje razumljiva in dostopnejša. Pomemben napredek je dosežen na področju (so)delovanja in »upravne administracije« nosilcev socialnih zavarovanj držav članic, kateri bodo postopno vsi prešli na elektronski način izmenjave podatkov (EESSI), s čimer bodo postopki priznavanja in izplačevanja pravic hitrejši in transparentnejši, varstvo pravic zavarovancev pa učinkovitejše. Kljub dosežkom nove »modernizirane« koordinacije sistemov socialne varnosti v Evropski uniji, odprta vprašanja ostajajo. Pomanjkljivost predstavlja »zaprta« stvarna veljavnost (pravice/dajatve, ki so predmet evropske koordinacije, so naštete taksativno in ne primeroma); vzporedna veljava stare in nove ureditve; vprašanje pomena novih definicij in dejanske učinkovitosti pravil v praksi; priprava (prehod) in končno delovanje enotnega elektronskega sistema. V prehodnem obdobju sta še posebej pomembni sodelovanje med nacionalnimi nosilci socialnih zavarovanj in pomoč s strani organov Evropske unije. Upoštevaje izzive sodobne družbe ter kompleksnost in raznolikost nacionalnih sistemov socialne varnosti držav članic, pri čemer imajo države članice na ravni Evropske unije pravico, da same urejajo svoj sistem socialne varnosti, poenotenega (unificiranega) evropskega sistema socialne varnosti nikoli ne bo mogoče doseči. Title:Borders of the contunuation use of the regulations on the coordination of social security in EU and further development of the European system of social security
Abstract:Within law of social security of the European Union a new enactment on coordinating social security systems came to power on 1st May 2010. Regarding the continuation and further use of the (new) coordination rules, which are highly associated with the free-travelling immunity, the current work introduces an analysis of the comparative and lawful overview of the old and new legal regulation. According to the future development of the European social security system the work questions problematic issues, sets out the judiciary practice of the Court of Justice of the European Union, and discusses problems on modernising a unified European social security system. On behalf of restructured contents, the new enactment on social security system coordination still assuring and increasing the free-travelling immunity in the first place holds no greater changes. The crucial rules stay in power and the main intention of coordination is to connect social security systems without unifying (harmonizing) them. Simplification and modernisation are the main goals of the new enactment. Last but not least, some ‘technical’ changes (‘administrative’ progress) and new guidelines regarding decision processes on social rights are of great importance as they consecutively insure a higher level of rights protection. The material validity (complemented by the contributions on behalf of fatherhood and by rights on pre-retirement ‘only’) of social security system coordination stays in charge and enables no new ‘independent’ rights, although there have been put out some rights, contributions and services by the judgements of the Court of Justice of the European Union for several times already, which should be a matter of coordination (rights on behalf of long-term nursing, medical services and contributions to those, who are under threat from becoming unemployed). For the usage continuation of coordination rules (and further development of the European system/social security law as well) the ‘new’ and extended personal validity of the new coordination enactment including all citizens of the European Union, the economically active and inactive ones, is more than urgent. Due to the circumstances mentioned, the new regulation lays great stress upon provisions dealing with the European citizenship, social solidarity and basic principles on the social security system coordination (above all, the territorial principle and the principle of equal treatment). In general, the new enactment upgrades the European coordination principles and strengthens their function. As many coordination rules have experienced modernization, clearness, simplification, transparency and better structure, now they are much more understandable and accessible to rightful claimants/insured people (they have actually been designed for). By regulating the gradual introduction of the Electronic Exchange of Social Security Information (EESSI), a great achievement has been attained in the field of cooperation, processing and ‘ruling administration’ of the holders of social insurances from the member states of the European Union, as the processes of conceding and paying out claims will become faster and more transparent, and the protection of insurants’ rights much more efficient. In spite of achievements of the new and ‘modernised’ social security system coordination of the European Union, a lot of questions have remained. The ‘closed’ material validity (rights/contributions regarding the European coordination are listed appraisingly instead of comparatively); parallel validity of the old and new regulation; significance of new definitions and actual efficiency of rules in practice; preparative arrangements (transition) and final operation of the unified electronic system stay the main deficiency of the new enactment.
