Title:HIPOTEKARNI PRODUKTI IN NJIHOV VPLIV NA FINANČNO KRIZO

Abstract:Z padcem cen nepremičnin se je hipotekarna kriza razširila na finančni sektor. Tako imenovana kriza neprvorazrednih posojil je negativno prizadela prebivalstvo, investitorje, posojilojemalce in ekonomske sisteme po celem svetu. Izvor krize povezujemo z ZDA, kjer so institucionalni posojilodajalci in hipotekarni posredniki z kompleksnimi hipotekarnimi posojili preplavili trg. Nadaljnja prodaja posojil na hipotekarnem trgu v obliki hipotekarnih obveznic je postopno zmanjševala kakovost posojil. Nepregleden proces listninjenja na sekundarnem trgu sproža veliko dilem. Listninjenje je učinkovit mehanizem s katerim se razprši tveganje, vendar se med udeleženci pojavljajo konflikti interesov. Proces listninjenja potrebuje temeljitejšo pravno podlago, katera bo preprečevala asimetrijo informacij in moralni hazard med udeleženci. Nepoznavanje tveganj, katerega nosijo izvedeni finančni instrumenti, je veliko investitorjev, tudi banke, privedlo do izgub. Odsotnost nadzora na tem segmentu, se je izkazalo za pogubno. Banke so preko posebnih podjetij za prenos sredstev tako v ZDA, kot tudi Evropi, investirale v nekakovoste dolžniške instrumente. To jim je omogočala zakonodaja, katera ni sledila razvoju finančne industrije. Slaba pravila glede kapitalske ustreznosti bank potrebujejo v prihodnosti poglobljeno analizo, nadzorne institucije držav sveta, pa zaradi vedno večje finančne globalizacije, enotna pravila in dobro poslovno prakso. Slednja naj bi omogočila preprečevanje in odkrivanje bodočih makroekonmskih neravnovesij.

Title:THE EFFECTS OF MORTGAGE PRODUCTS ON FINANCIAL CRISIS
Abstract:11. ABSTRACT With property prices falling, the mortgage crisis has spread to the financial sector. The so-called crisis of subprime mortgage has negatively affected the population, investors, borrowers and economic systems worldwide. The origin of the crisis is associated with the U.S.A, where institutional lenders and mortgage brokers with the complex mortgage have flooded the market. Resale of loans on the mortgage market in the form of mortgage- backed security has gradually decreased the quality of loans. The opaque process of securitization on the secondary market raises many dilemmas. Securitization is an efficient mechanism by which the risk is dispersed, but a conflict of interest can emerge among the participants. The securitization process requires a more thorough legal basis which would prevent information asymmetry and moral hazard among the participants. Ignorance of the risks, borne by collateral debt obligation, has led many investors to losses, including banks. Lack of control in this segment has proved to be disastrous. The banks have through special purpose vehicles invested in low quality debt instruments in the U.S. as well as in Europe. This was made possible due to the legislation which does not follow the development of the financial industry. Poor capital adequacy rules for banks thus need future in-depth analysis, and world supervisory institutions, due to increasing financial globalization, need uniform rules and a good business practice. The latter would allow for the detection and prevention of future macroeconomic imbalances.
