Title:OTROKOVE PRAVICE IN PRAVNI VIDIKI TELESNEGA KAZNOVANJA OTROK SKOZI ZGODOVINO

Abstract:Otroci skozi zgodovino niso uživali nobenih pravic. Od antike do danes so se pravice otrok sicer nekoliko spreminjale, glavno vodilo vzgoje otroka pa je kljub vsemu bilo telesno kaznovanje. Šele v 20. stoletju so se pojavile prve težnje o ureditvi otrokovih pravic kot posebne skupine, najprej z Ženevsko deklaracijo o otrokovih pravicah iz leta 1924, še posebej pa z Deklaracijo o otrokovih pravicah iz leta 1959. Po tem dokumentu so nekatere države vzele pravice otroka pod drobnogled in jih uredile v svoji notranji zakonodaji. Največji preboj v ureditvi pravic otroka pa je bil dosežen s Konvencijo Združenih narodov o otrokovih pravicah iz leta 1989, ki podrobno ureja pravice otroka, hkrati pa ustanavlja Odbor za otrokove pravice, nadzorni organ nad izvajanjem konvencije, kateremu so države pogodbenice dolžne poročati o doseženih ukrepih. Odbor podaja tudi sklepne ugotovitve na ta poročila ter daje priporočila za izboljšanje ali sprejetje novih ukrepov glede pravic otrok. S tem dokumentom, ki je mednarodnopravno zavezujoč, se je nivo otrokovih pravic zelo izboljšal, tudi v Republiki Sloveniji. Konvencija pa si prizadeva tudi za odpravo telesnega kaznovanja otrok, kar ji je v mnogo državah tudi uspelo, velik premik na tem področju pa je bil dosežen tudi v Republiki Sloveniji, z Zakonom o preprečevanju nasilja v družini iz leta 2008, ki je definiral tudi fizično obliko nasilja v družini, v bližnji prihodnosti pa naj bi začel veljati Družinski zakonik, ki izrecno prepoveduje telesno kaznovanje otroka. Tako so se v zadnjih dvajsetih letih, po zaslugi Konvencije o otrokovih pravicah, pravice otrok zelo izboljšale, vse več držav pa odpravlja tudi telesno kaznovanje.

Title:CHILDREN RIGHTS AND LEGAL ASPECTS OF CORPORAL PUNISHMENT THROUGH HISTORY
Abstract:Children throughout history did not enjoy any rights. From ancient times until today, the children rights has been changing in a way, but the main course of child-raising was still corporal punishment. Only In the 20th century, the first tendency of children's rights organization raised, starting with the Geneva Declaration on the Rights of the Child in 1924, and also with the Declaration on the Rights of the Child in 1959. According to this declaration, some countries took a child right under the microscope and they settled in their internal legislation. The biggest breakthrough in the organization of child rights has been made by the United Nations Convention on the Rights of the Child in 1989, which exactly regulated the rights of the child, and also set up a Committee for the Rights of the Child, the supervisory authority, which tasks is supervising the implementation of the Convention, to which Contracting States are obliged to report on the achievement measures. The Committee also makes the final reports and make recommendations for improvement or adoption of new measures relating to the rights of children. With this document, which is binding in international law, the level of children's rights has greatly improved, even in Slovenia. The Convention effort is also to eliminate corporal punishment of children, which in many countries succeeded. A major shift in this area has also been made in the Republic of Slovenia, with the Law on Prevention of Domestic Violence Act from 2008, which also defined the physical form of domestic violence. In the near future, the Family Code will enter into force, which explicitly prohibits corporal punishment of children. Thanks to the Convention on the Rights of the Child, during the last twenty years, children's rights has improved, and more and more countries removes corporal punishment.
