Title:UREDITEV DISKRIMINACIJE V VELJAVNI ZAKONODAJI TER KONVENCIJAH, NA PODROČJU ZAPOSLOVANJA IN DELA, V RAZMERJU S TUJIM ELEMENTOM

Abstract:Prepoved diskriminacije in načelo enakih možnosti pri zaposlovanju je kot splošno načelo obravnavano v številnih mednarodnih ter nacionalnih dokumentih, ki urejajo posebej področje dela in zaposlitve. Dokumenti izhajajo iz prepovedi diskriminacije na podlagi različnih osebnih okoliščin. V nalogi se poleg problema diskriminacije pri zaposlovanju in delu, osredotočam tudi na diskriminacijo pri zaposlovanju in delu v razmerjih, ki vsebujejo mednarodni element. Za okvirno sliko problema se je potrebno najprej ozreti po zgodovini problema in stoletnim naporom različnih neodvisnih organizacij (kot MOD), držav in regionalnih povezav, ter si ustvariti pregled nad njihovimi bogatimi rezultati dela iz tega področja. Prav tako je ureditev problematike potrebno obravnavati na različnih nivojih. Izhajam iz opredelitve pojmov na nacionalni ravni, ter ureditve problematike na ravni zakonov in ustave. Napredujem na raven Evropske zakonodaje, kateri sledi pregled obstoječe sodne prakse Sodišča ES, ki je pomembna tudi s stališča evroavtonomne interpretacije zakonodaje. Na koncu sledi še pregled organizacij, aktivnih na tem področju.

Title:THE PROHIBITION AGAINST DISCRIMINATION IN VALID LEGISLATION AND CONVENTIONS IN RELATIONS WITH INTERNATIONAL ELEMENT
Abstract:The prohibition against discrimination and the principle of equal opportunities in area of employment is as fundamental principle includet in numerous international and national documents, that manage area of work and empoyment. Documents are based on prohibition of diskrimination on basis of diferent personal circumstances. In my research project, the focus of the problem of discrimination in area of employment and work, is being expanded whith international element. For basic understanding of problem, first the history review of problem must be made, the abstract of hunderd years of work from differend undependent organizations (such as ILO), countrys and regional organizations, and to get to know the results they have achieved on this area. The problem must also be discussed on differend levels. I originate from definiton of basic on national level and the level of constitution. Then further I write about legal framework of the European Union, and in this connection the Court of Justice of the European Communities, which is importanat for reaching number of decisions, that have to be used as euroautonomic interpretation of legislation. On end there is a review of organizations, that are active on these area
