Title:PRAVNO VARSTVO V PRIMERIH TRPINČENJA NA DELOVNEM MESTU

Abstract:V Republiki Sloveniji (RS) lahko žrtve trpinčenja šele od leta 2007 in 2008 zahtevajo pravno varstvo. RS je članica treh pomembnejših mednarodnih organizacij: Evropske unije, Sveta Evrope in Mednarodne organizacije dela. Zato je morala izpolniti svoje obveznosti in uskladiti svoje pravo z direktivami in ostalimi akti organizacij, ki nakazujejo ureditev trpinčenja. Za to je poskrbel Državni zbor s spremembo zakonodaje na področju delovnega in kazenskega prava. Novela zakona o delovnih razmerjih (ZDR-A) strogo prepoveduje trpinčenje na delovnem mestu, delodajalcu pa nalaga določene obveznosti v zvezi s preprečevanjem le tega. Delodajalec je namreč delavcu odškodninsko odgovoren, če ne zagotavlja delovnega okolja brez trpinčenja. Trpinčenemu delavcu pa zakonodajalec olajša položaj tako, da v pravdi prevali dokazno breme na delodajalca. V primeru ko delodajalec ne sprejme ustreznih splošnih aktov, ki predvidevajo preprečevanje in ukrepanje, ko do trpinčenja pride, niti ne zagotovi ustreznega delovnega okolja brez trpinčenja, ga lahko inšpektor za delo oglobi. ZDR daje trpinčenemu delavcu tudi možnost izredne odpovedi pogodbe o zaposlitvi. Na delovnopravnem področju se zavzemata za delovno okolje brez trpinčenja še Zakon o javnih uslužbencih (ZJU) in ravnokar sprejeti Zakon o varnosti in zdravju pri delu (ZVZD-1). Nova kazenskopravna zakonodaja pa s prenovljenim Kazenskim Zakonikom (KZ-1) obravnava trpinčenje kot kaznivo dejanje. Zanj je zagrožena zaporna kazen tudi do treh let.

Title:LEGAL PROTECTION IN CASE OF MOBBING
Abstract:The victims of mobbing in Republic of Slovenia (RS) are able to require the legal protection since 2007 and 2008. RS is a member of three major international organizations: the European Union, Council of Europe and ILO. Therefore, to meet its commitments and to coordinate their law directives and other acts of organizations that indicate ill-treatment regime. This was provided by the National Parliament to amend the legislation on employment and criminal law. The amendment to the Employment Relations Act (ERA-A) strictly prohibits harassment in the workplace, the employer and imposes certain obligations in relation to the prevention of it. The employer is obliged to provide the employee monetary compensation if it does not provide a workplace free of harassment. The Law provides the employee victim in the case of a lawsuit that the proof of the blame is put on the side of the employer. In the case where the employer fails to take appropriate measures of general application that provide prevention and intervention, when the bullying occurs, nor does it provide an appropriate work environment free of harassment, you can fined the labour inspector. The ERA gives the harassed employee the possibility of extraordinary termination of the employment contract. The Law on Civil Servants (Civil Servants Act) and the Law on Safety and Health (OSH-1) are also dealing with harassment connected to working environment. New criminal legislation and a renewed Penal Code (PC-1) deals with torture as a crime. For these acts the Law provides the punishment by imprisonment up to three years.
