Abstract:Zakon o delovnih razmerjih (Uradni list RS, št. 42/02 – ZDR in 103/207 – ZDR-A), ki je bil sprejet na podlagi usklajevanja med socialnimi partnerji in večletnimi pripravami na novo delovno zakonodajo, ureja samo individualna delovna razmerja in ne več kolektivnih delovnih razmerij, sistem kolektivnih pogodb pa ureja Zakon o kolektivnih pogodbah (Uradni list RS, št. 43/2006 - ZKoIP). Ker ZDR ravno na področju odsotnosti z dela prepušča največ pristojnosti kolektivnim pogodbam, v praksi prihaja do razlik, kjer so v prednosti predvsem delavci zaposleni v javnem sektorju. Drugo novost v delovnopravni zakonodajo pa predstavlja tudi Zakon o starševskem varstvu in družinskih prejemkih (Uradni list RS, št. 110/2006-UPB2 in 10/2008 - ZSVDP), ki je uvedel novost, t. j. očetovski dopust. V diplomskem delu sem se lotil obravnave letnega dopusta in drugih odsotnosti z dela, ki tudi za Slovenijo predstavljajo vedno večji družbeni, organizacijski in pravni problem, ki ima tudi ekonomske posledice za delavce, delodajalce in narodno gospodarstvo. Predstavil sem tudi, kako je urejeno področje koriščenja letnega dopusta in drugih odsotnosti v Carinski upravi R Slovenije in kako se zoper določene vrste odsotnosti (predvsem zoper zdravstveni absentizem) borijo v Sloveniji in v drugih državah.

Title:ANNUAL LEAVE AND OTHER ABSENCES FROM WORK
Abstract:Employment Relationships Act that has been accepted on the co-ordination of social partners and many years of preparations basis, regulates only individual employment relationships and no longer collective employment relationships. System of collective agreements should be regulated by a special act on collective agreements that unfortunately has still been in the legislative procedure and for the part covering the collective agreements system the provisions of the old Employment Relationships Act and the Basic Employment Rights Act are applied therefore. Since the Employment Relationships Act in the area of absence from work grants most powers to collective agreements, in practice differences emerge where the public sector employees are in a privileged position. Another novelty in the work law is also the Parenthood Care and Family Benefits Act introducing the novelty, i. e. paternity leave. In the present diploma work, I deal with annual leave and other absences from work that in Slovenia too have become a more pronounced social, organisational and legal problem having also an economic impact on employees, employers and national economy. I also present how the area of using annual leave and other absences from work in the Customs Administration of the Republic of Slovenia is regulated and how other countries fight against certain kinds of absences (against health absenteeism in the first place).
