Title:Neprostovoljna hospitalizacija duševno motenih oseb v Republiki Sloveniji : diplomsko delo

Abstract: Neprostovoljno hospitalizacijo duševno motenih oseb v Republiki Sloveniji od leta 2008 ureja Zakon o duševnem zdravju. Pred tem sta to področje urejala kar dva zakona, in sicer Zakon o zdravstveni dejavnosti in Zakon o nepravdnem postopku. Psihiatrična stroka je kritizirala tako staro kot novo ureditev neprostovoljnega zdravljenja duševno bolnih oseb. Kritike zakonodaje so prisotne tudi v tujini, na primer v Avstriji. Nanašajo se predvsem na zmanjšanje uspeha zdravljenja. To povezujejo z zmanjšanjem števila neprostovoljnih hospitalizacij, ki ima za posledico povečanje forenzičnih hospitalizacij. Forenzične hospitalizacije poznamo tudi pri nas. Pod to bi lahko šteli varnostni ukrep obveznega psihiatričnega zdravljenja in varstva v zdravstvenem zavodu, ki ga namesto kazenske sankcije »dosodijo« neprištevnemu storilcu kaznivega dejanja. Kljub ustaljenemu prepričanju, duševno motene osebe niso bolj nasilne od splošne populacije, razen v obdobjih poslabšanj določenih bolezni. Bolj pogosto ogrožajo sebe kot druge, zaradi česar je pravočasna zdravstvena pomoč ključnega pomena. Večjo nevarnost za druge predstavljajo ljudje, ki so osebnostno moteni. Ker ne spadajo med duševno bolne, jih ukrep neprostovoljne hospitalizacije ne zadeva. Za zdravljenje duševno bolnih oseb je bolj primerna prostovoljna hospitalizacija, ker zaradi pristanka v zdravljenje omogoča večje sodelovanje in posledično boljši uspeh. Ko se osebe pozdravijo, v mnogih primerih odobravajo hospitalizacijo, saj razumejo njeno nujnost za ozdravitev.

Abstract: The involuntary hospitalisation of people with mental health disorders in Slovenia is being controlled by the “Mental Health Act” since 2008. Before that there were two different acts regulating the area, the “Health Services Act” and the “Act on Non-Litigious Proceedings”. Psychiatric profession has criticised both the old and the new regulations of involuntary treatment of mentally ill persons. Criticism of the legislation is also present abroad, e.g. in Austria. It is mainly related to the reduction of treatment success, which results in a reduction of involuntary hospitalization, resulting in an increase of forensic hospitalisations. Forensic hospitalisations are also known in Slovenia. The safety measure of obligatory psychiatric treatment and care in a medical facility could be considered as a form of forensic hospitalization. It is sentenced to a crime offender, who is innocent due to insanity, instead of a prison. Despite a general belief, mentally disturbed persons are not more violent than the general population, except during the aggravation. They endanger themselves more often than others, which is why the timely medical assistance is crucial. The greater danger to others represent the people with personality disorders. Since they are not considered mentally ill, the measure of involuntary hospitalization does not affect them. Voluntary hospitalization is more appropriate for the treatment of people with mental health disorders, because the consent to treatment leads to greater participation and gives better results. When they get healthy, in many cases they approve of hospitalization, because they understand the need of it in order to get better.
