Title:Zdravstvene in socialne pravice za starejše

Abstract:Gerontologija je znanstveno preučevanje vseh fenomenov staranja. Staranje se domnevno nanaša na upadanje življenskih funkcij v odrasli dobi. O staranju prebivalstva govorimo, kadar se delež prebivalstva nad določeno starostno mejo (običajno 65 let) povečuje, sočasno pa se zmanjšuje število otrok, mlajših od 15 let in podaljšuje življenska doba prebivalcev. V številnih državah je opazna vedno daljša življenska doba in posledično naraščanje deleža populacije starejših. Slovenija in tudi druge države se morajo zato, glede na napovedi in staranje prebivalstva, primerno odzivati in prilagajati sisteme socialne varnosti. Zagotavljanje pravic do kakovostnega življenja v starosti ne pomeni le reševanje materialnih problemov, skrbi za prilagoditev finančne vzdržnosti pokojnin, zdravstvenih, socialnovarstvenih in drugih sistemov, ampak tudi reševanje nematerialnih potreb. Na kakovostno življenje je zato potrebno gledati iz treh enako pomembnih stališč za vsakega človeka: socialnega omrežja, zdravstvenega stanja in ekonomskega statusa. Pravica do socialne varnosti je temeljna človekova pravica in je določena tudi v slovenski ustavi. Socialno varstvo ureja Zakon o socialnem varstvu, kateri obsega storitve in ukrepe, namenjene preprečevanju in odpravljanju socialnih stisk in težav posameznikov, družin in skupin prebivalstva. Pravico do zdravstvenega varstva ima vsakdo, katere določa ZZVZZ. Pri obsegu in vrsti pravic, zakon ne deli zavarovanih oseb glede na starost, ampak že od vsega začetka je zakon vseboval nekatere varovalke za zaščito materialno ogroženih, invalidnih in starih ljudi. Večjo enakost v dostopu do storitev in drugih pravic bi moral zagotoviti Zakon o dolgotrajni oskrbi in zavarovanja za dolgotrajno oskrbo.

Title:Health and social justice for seniority
Abstract:Gerontology is a scientific study of all phenomena of aging. Aging refers to the decline of vital functions at adulthood. We can talk about aging when procentage of population above certain age (usually 65 years) increases, at the same time the number of children younger than 15 decreases and the life expectancy of the inhabitants prolongs. Longer life expectancy can be noticed in numerous countries as the result of the increasing of older population. That is why Slovenia and other countries have to react properly to these predictions and the aging of population and adjust the system of social welfare. Providing the rights to quality of life at old age does not mean just solving financial problems, taking care of adjusting the financial maintenance of pensions, health, social welfare and other systems, but also solving immaterial needs. There are three important aspects for quality life of every individual. Social network, health condition and economical status. Right to social welfare is the fundamental human right and is also defined in the Constitution of the Republic of Slovenia. Right to social welfare is defined with the legislation in Social Care Law (Zakon o socialnem varstvu) which covers services and measures which should prevent and eliminate social distress and problems of individuals, families and groups. Everyone is entitled to health care which is defined with ZZVZZ. The law does not divide people according to their age, but from the very beginning, the law has provided some protection of socially deprived, disabled and old people. Greater equality in access to services and other rights should be provided by Long term Care Law (Zakon o dolgotrajni oskrbi) and the right to long term care insurance.
