Title:HORIZONTALNI NEPOSREDNI UČINEK DOLOČB DIREKTIV, KI IZVAJAJO SPLOŠNA NAČELA PRAVA EU

Abstract:Neposredni učinek je kot doktrina sodnega varstva eden ključnih elementov za zagotavljanje učinkovitosti prava EU. Učinkovitost prava je zagotovljena zlasti takrat, ko imajo posamezniki možnost, da uveljavljajo pravice, ki jim jih zagotavlja pravo EU in takrat, ko so njihove pravice v primeru kršitev tudi zaščitene. Bistvo izgrajenega sistema varstva pravic, ki jih daje pravo EU, pa je ravno v tem, da je posameznikom omogočeno neposredno sklicevanje na norme prava EU. Neposredni učinek tako omogoča izvrševanje prava EU s strani številnih nacionalnih sodišč in upravnih organov po vsej Evropski uniji in na ta način zagotavlja potrebno učinkovitost. Medtem ko je področje neposrednega učinka že dolga leta jasno urejeno na ravni ustanovitvenih Pogodb in uredb, je na ravni direktiv zlasti kar zadeva horizontalni neposredni učinek zadeva kompleksnejša. Dolgoletna sodna praksa je namreč uveljavila prepoved horizontalnega neposrednega učinka direktiv. To pravilo je veljalo vse do leta 2010, ko je bila s strani Sodišča izdana sodba v zadevi Kücükdevci, za katero se zdi, da pomeni velik korak v smeri priznanja horizontalnega neposrednega učinka tudi na področju direktiv. Novo pravilo se namreč glasi, da direktive, ki izvajajo splošna načela prava EU, lahko ustvarjajo učinke tudi v razmerjih med posamezniki. Pričujoče diplomsko delo tako v veliki meri obravnava problematiko horizontalnega neposrednega učinka direktiv in se zlasti osredotoča na kontroverzno sodbo Sodišča v zadevi Kücükdeveci. V zvezi z omenjeno sodbo je obravnavano predvsem vprašanje njenega pomena in posledic, ki jih bo imela v prihodnosti. Za lažje razumevanje celotne tematike pa je v diplomskem delu razložena tudi teorija s področja doktrine neposrednega učinka na splošno, njen razvoj in teorija s področja splošnih pravnih načel.

Title:HORIZONTAL DIRECT EFFECT OF DIRECTIVES THAT GIVE EXPRESSION TO THE GENERAL PRINCIPLES OF EU LAW
Abstract:The direct effect as a doctrine of a judicial protection is one of the key elements for ensuring the effectiveness of EU law. The effectiveness of law is guaranteed especially when individuals are able to assert their rights that are guaranteed by EU law and when their rights are protected in case of a breach. The essence of the system which assures protection of rights is that individuals are enabled to refer directly to the norms of EU law. Direct effect enables the implementation of EU law by a number of national courts and administrative bodies throughout the whole European Union and thereby ensures the necessary efficiency. While the direct effect has for a long time been clearly regulated as regards the treaties and regulations, the situation in respect of directives, especially in the scope of horizontal direct effect, is more complex. The long-standing case-law has enforced prohibition of horizontal direct effect of directives. This rule stood until 2010 when the Court of Justice of the EU issued its judgment in the case of Kücükdevci, which seems to mean a big step towards the recognition of horizontal direct effect of directives. The new rule is: the directives that give expression to the general principles of EU law can produce effects in the relationships between individuals. The present paper thus largely deals with the issue of horizontal direct effect of directives with a particular focus on the controversial case Kücükdeveci. In connection with the abovementioned case it is especially discussed the question of its meaning and consequences that this case will have in the future. For easier understanding of the whole theme this paper also explains the theory of direct effect doctrine in general, its development and theory from the field of general legal principles.
