Title:MOŽNOST ODVZEMA ŽIVALI

Abstract:V diplomskem delu je obravnavana tematika možnosti odvzema živali v Sloveniji glede na posamezne predpise. Predstavljene so težave, nedorečenosti, slabe in dobre rešitve v postopku, predlaganih pa je tudi nekaj novih. Predstavljena je situacija, ko je možnost odvzema živali predvidena, če je storjen prekršek, ne pa tudi, kadar je storjeno kaznivo dejanje mučenja živali. Nadalje je predlagana uvedba sankcije prepovedi posedovanja živali in sankcije psihološkega svetovanja v določenih primerih mučenja živali. Poudarjena je pomembnost registracije in identifikacije živali, saj je včasih to edini način, da se identificira lastnika trpeče živali. Uzakoniti bi bilo potrebno obvezno mikročipiranje mačk. Predlagan je popis vseh pasjih legel, ne le rodovniških - vsaka kotitev bi morala biti prijavljena (mladiči pa cepljeni in mikročipirani še preden gredo v nove domove), sicer naj se lastnika kaznuje. Onemogoči naj se oddajanje oglasov in trgovanje z mladiči, če dejavnost ni prijavljena oziroma registrirana. To bi pri tistih, ki se jim »dogajajo« legla iz malomarnosti oziroma neželena legla, spodbudilo kastriranje in steriliziranje živali. Verjetno pa bi se v izogib stroškom (kastracije, sterilizacije ali pa cepljenja in mikročipiranja mladičev) še naprej dogajali primeri pobojev mladičev, ki pa bi morali biti strogo sankcionirani. Predpostavka seveda je, da ljudje kršitelje prijavijo. Ena izmed rešitev za zmanjšanje števila neželenih legel bi bila možnost brezplačne kastracije in sterilizacije psov in mačk. Na koncu so analizirani trije novejši dejanski primeri, ki jih obravnava Veterinarska uprava Republike Slovenije (VURS), z namenom pokazati, kakšen in kako dolg je postopek, preden pristojni lahko ukrepajo.

Title:POSSIBILITY OF ANIMAL CONFISCATION
Abstract:Diploma thesis deals with the possibilities of confiscating animals in Slovenia according to certain regulations. Problems, ambiguities, negative and positive solutions in a procedure are presented while some new are proposed. Also presented is a situation with an anticipated possibility of confiscating an animal when a misdemeanour has been done as opposed to a criminal act of animal cruelty which is not punished with animal confiscation. Further sanctions are proposed such as prohibition of animal possession and psychological counselling in certain cases of animal cruelty. The importance of animal registration and identification is emphasised as it is sometimes the only way to identify the owner of a suffering animal. A mandatory cat microchipping should be imposed by law. Registration of all dog litters, not just pedigree, is proposed – each and every litter should be registered (and cubs vaccinated and microchipped before leaving for a new home) otherwise owners should be penalised. Posting advertisements and trading cubs should be prevented unless registered. This would prompt negligent owners who have »unplanned« litters to castrate and sterilize their pets. In order to avoid unwanted expenses there would probably still be cases of cub killings that should be severely penalised if reported. One of the solutions for reducing number of unwanted litters is an option of free of charge castration and sterilization of dogs and cats. At the end there is an analysis of three recent actual cases that are considered by Veterinary Administration of the Republic of Slovenia (VARS) with the intention of showing how long and complicated the procedure is before the authorities can take any action.
