Title:ZVESTOBA PRED BOGOM IN (ALI) DRŽAVO (PRIMERJAVA CIVILNE IN CERKVENE [RIMOKATOLIŠKE] POROKE V SLOVENIJI)

Abstract:Število sklenjenih porok v Svetu, Evropi in Sloveniji je v zadnjih letih v upadu. Narašča pa število izvenzakonskih zvez. Kljub statistiki poroka ostaja med pomembnejšimi družbenimi običaji, z nekaterimi spremembami samega poročnega rituala. Medsebojno in hkrati javno priznanje zveze med dvema, ki sklepata zakon, je bila, je in bo v vseh družbah, kulturah in družbenih slojih tako pomembno, da ga varuje poseben zakon, tako na državni kot na cerkveni ravni. Z diplomsko nalogo Zvestoba pred bogom in (ali) državo sem analizirala dva ideološka pola, ki sta si, skozi zgodovino, drug drugemu prevzemala prioriteto nad poseganjem v intimnost ter svobodo odločanja dveh, ki sta želela živeti skupno življenje. V Sloveniji danes poroko in zakonsko zvezo ureja, na državni ravni, Zakon o zakonski zvezi in družinskih razmerjih, v rimokatoliški cerkvi pa Zakonik cerkvenega prava. Poroka je del ritualov prehoda, s katerimi družba/kultura posamezniku podeli nov družbeni status ali bolje rečeno, družba odobri zvezo med dvema osebama. S tem država in cerkev nadzorujeta in urejata ekonomska razmerja, neprofitno prostovoljsko delo, brez katerega bi vsaka družba bankrotirala ter spolnost in posledično reprodukcijo otrok v zakonu. Funkcija poroke in vidni poročni simboli so pri cerkveni in civilni poroki enaki. Bistvena razlika se pojavi pri samem poročnem obredu, kjer civilno poročena zakonca skleneta pravno veljavno pogodbo, med tem ko cerkveno poročena zakonca se zaobljubita drug drugemu in bogu. Tako cerkvena poroka v Republiki Sloveniji nima civilno pravnih posledic, prav tako pa cerkvena razveza ne obstaja, saj je poroka sveti zakrament.

Title:LOYALITY BEFORE GOD AND (OR) STATE (COMPARISON OF CIVIL AND CHURCH [ROMAN CATHOLIC] WEDDINGS IN SLOVENIA)
Abstract:The number of marriages all over the world, in Europe and in Slovenia has been decreasing over the last few years. On the other hand, the number of unmarried couples is on the increase. In spite of the statistics, the marriage with some variations of the wedding ritual ceremony remains one of the most important social customs. A mutual as well as public appreciation of the relationship of the married couple has been and it will always be in all societies, cultures and social classes of great importance in such a manner as to be protected by church and as well as state laws. In my diploma paper Loyality before God and (or) state (comparison of civil and church [Roman Catholic] weddings in Slovenia there were analysed two ideological poles that were exchanging its dominance throughout the history over the interfering with intimacy and free decision of a couple to live together. In Slovenia marriages and matrimonies are regulated by Marriage and Family Relations Act on a state level and The Code of Canon Law in Roman Catholic Church. A marriage is a part of a rite of passage where a new social status is imparted to individual by the society, or in other words the relationship is approved by the society. The state and the church are thus in control and in position to regulate the economic relationships, unprofitable voluntary work, sexuality and consequently the reproduction of children in a marriage. The function of a marriage and visible symbols of marital status are at a civil and church marriage the same. The main difference appear at the ceremony, where the civil married couple sign valid marriage contract, while a couple married in church take vows to each other and God. A church marriage in the Republic of Slovenia, however, does not have any legal consequences, furthermore, the Catholic Church does not grant divorce, as a marriage being a holy sacrament.
