Title:DAVČNE IMPLIKACIJE DOLŽNIŠKEGA FINANCIRANJA Z VIDIKA SLOVENSKE DAVČNE ZAKONODAJE V PRIMERJAVI Z NEKATERIMI DRŽAVAMI EU

Abstract:Glavni cilj magistrske naloge je prikazati z davčnega vidika prednosti dolžniškega financiranja pred lastniškim financiranjem. Dolžniško financiranje pomeni izposojo denarja iz zunanjih virov z obveznostjo plačila glavnice in obresti po dogovorjeni stopnji. Čeprav imajo omenjeni pogoji izposoje negativen prizvok, se podjetja največkrat odločajo za financiranje svojega poslovanja z dolžniškim financiranjem, kljub temu da bodo v svoji bilanci stanja izkazovala dolg. V finančni terminologiji je financiranje z dolgom največkrat omenjeno kot financiranje z vzvodom (leverage v ZDA in gearing v VB) . Financiranje z dolgom pomeni največkrat izposoja finančnih sredstev v banki, toda zaradi davčnih ugodnosti je lahko to tudi izposoja pri povezanih osebah (matični družbi, družina itd.). Medtem ko pri lastniškem financiranju gre za vlaganje finančnih sredstev iz notranjih virov oziroma vlaganje finančnih sredstev s strani lastnikov.Glavna prednost dolžniškega financiranja z davčnega zornega kota je, da so obresti kot strošek dolžniškega financiranja odbitna postavka za davčne namene, medtem ko dividende kot strošek lastniškega kapitala niso. Podjetja lahko dolg uporabijo kot davčni ščit (obrestni davčni ščit), in to zaradi obresti, ki za davčne namene pomenijo davčno priznan odhodek. Tako lahko dolg pomeni davčni ščit, ker zmanjšuje davčno osnovo. Vrednost davčnega ščita pa je odvisna od davčne stopnje davka od dohodka pravnih oseb pri posojilojemalcu (višja bo davčna stopnja, večja bo vrednost davčnega ščita).

Title:Tax implications of tax optimization with debt financing in light of Slovenian tax system and comparison with some other member states in EU
Abstract:The main goal of this master work is find the benefits of debt financing in front of equity financing from tax perspective. Deb financing is borrowing money from an outside source with the promise to return the principal, in addition to an agreed-upon level of interest. Although the term tends to have a negative connotation, startup companies often turn to debt to finance their operations. In fact, even the healthiest of corporate balance sheets will include some level of debt. In finance, debt is also referred to as "leverage". The most popular source for debt financing is the bank, but for tax reasons debt can also be issued by a related person (parent company or even a family member or other related persons. Meanwhile is equity financing invest of money from an inside source or financing with money of owners.The major benefit of debt financing from tax perspective is that interest expenses are deductible from corporate profits, while dividend payments to equity holders are not. Companies may use debt as a tax shield (interest tax shield), because interest payments for debt are typically deductible from taxable profits while equity costs are not. Thus, debt can act as a tax shield because taxable profits are reduced. The value of this tax shield obviously depends on the corporate tax rate of the borrowing entity (the higher the tax rate, the higher the value of the debt tax shield).
