Title:OMEJITVE ZA JAVNE USLUŽBENCE IN FUNKCIONARJE PRI OPRAVLJANJU JAVNIH FUNKCIJ V JAVNI UPRAVI

Abstract:Diplomska naloga obravnava omejitve za javne uslužbence in funkcionarje pri opravljanju njihovih javnih funkcij v javni upravi. Javni uslužbenci kot posamezniki, ki kot svoj poklic opravljajo izvršne in upravne naloge v upravnem sistemu, ter funkcionarji kot imenovani ali izvoljeni subjekti izvrševanja oblastih funkcij, predstavljajo glavni kategoriji subjektov v organizacijah javne uprave. Omejitve pri njihovem javnem delovanju v najširšem pomenu besede predstavljajo mejo med dovoljenim in prepovedanim ravnanjem teh oseb ter omenjenim subjektom določajo konkretne prepovedi, zapovedi ali posebne dolžnosti. Diplomsko delo je splošno razdeljeno na tri temeljne dele, kjer so v prvem delu skladno z obravnavano tematiko predstavljeni temeljni pojmi, sledi podrobna predstavitev javnih uslužbencev in funkcionarjev, medtem, ko jedro diplomskega dela predstavlja podrobna obravnava temeljnih omejitev ter posledic njihovih kršitev. V določenih segmentih so predstavljene tudi podobnosti in razlike med istovrstnimi omejitvami, ki veljajo za javne uslužbence na eni ter za funkcionarje na drugi strani. Bistven namen omejevanja javnih uslužbencev in funkcionarjev pri njihovem javnem delovanju je onemogočanje izkoriščanja javnih funkcij ter zagotovitev nepristranskega opravljanja njihovih nalog, s čimer se ureja eno pomembnejših področij celotne družbe, to je preprečevanje korupcije. Skladno s tem namenom je možno omejiti delovanje javnih uslužbencev in funkcionarjev pri opravljanju njihovih javnih funkcij s predpisi o nezdružljivosti funkcij ter s predpisi o konfliktu interesov. Omejitve predstavljajo tudi posamezne norme, povezane s sprejemanjem daril ter predpisi o omejevanju poslovanja zadevnih oseb. Tudi nadzor nad premoženjskim stanjem določenih zavezancev ter druge določbe v zvezi s prepovedjo korupcije (npr. protikorupcijska klavzula) predstavljajo omejitve za obravnavane subjekte pri opravljanju njihovih javnih funkcij. S temi instituti se primarno preprečuje korupcija ter zagotavlja nepristransko, zakonito in transparentno delovanja tako javnih uslužbencev, kot tudi funkcionarjev, s ciljem dosega najvišje stopnje pravne, socialne ter nenazadnje tudi demokratične družbe.

Title:RESTRICTIONS FOR CIVIL SERVANTS AND OFFICIALS IN PERFORMING PUBLIC FUNCTIONS IN PUBLIC ADMINISTRATION
Abstract:The thesis discusses limitations / restrictions for public servants and officials in performing their public functions in the public administration. Public servants as individuals who professionally perform executive and administrative tasks in the administrative system and officials as elected or appointed subjects that execute authoritative functions constitute the main subject categories in public administration organisations. Most broadly speaking, limitations in terms of their public performance constitute the boundary between allowed and forbidden actions of these persons that lay down specific prohibitions, commands or special obligations. Generally speaking, the thesis is divided into three basic parts. The first part presents the basic terms pursuant to the discussed topic and is followed by a detailed presentation of public servants and officials. The core of the thesis constitutes a detailed discussion of the basic limitations for both subject categories in performing their public functions and the consequences of their violation. Certain segments also include similarities and differences between limitations of this kind that apply for public servants on the one hand and for officials on the other. The basic purpose of limiting public servants and officials in their public performance is to prevent them from taking advantage of and abusing their public functions as well as to ensure that their tasks are done legally and without bias, whereby one of the most relevant areas of the entire society, corruption prevention, is regulated. Pursuant to this purpose, the performance of public servants and officials in terms of performing their public functions can be limited by regulations on incompatibility of functions and regulations on conflicts of interest. Specific norms, related to acceptance of gifts and regulations on limiting the transactions of these persons, constitute limitations. Control over the material standing of certain tax payers and other provisions regarding prohibition of corruption (for example anti-corruption clauses) also constitute a limitation for the discussed subjects in performing their public functions. These institutes primarily prevent corruption and ensure an unbiased, legal and transparent performance of both public servants and officials whose objective is to achieve the highest levels of the rule of law, of a social and of ultimately also a democratic society.
