Title:SPLOŠNI IN POSEBNI REŽIMI STAVBNIH PRAVIC

Abstract:S sprejetjem Stvarnopravnega zakonika (v nadaljevanju: SPZ) je bila v slovenski pravni red vpeljana stavbna pravica. V svojem diplomskem delu želim celovito predstaviti ta pravni institut, ki je v praksi sicer že uveljavljen, vendar menim, da bi njegova uporaba lahko imela večji domet. Na to predpostavko nas navajajo razmere na področju stanovanjske gradnje, saj draga zemljišča zelo dražijo novozgrajena stanovanja, kot tudi zemljišča za gradnjo industrijskih objektov. Kvaliteta stavbne pravice se kaže v razmejitvi lastninske pravice na zemljišču in lastninske pravice na zgradbi. Pri tem je pomembna ugotovitev, da se na ta način vzpostavi različen pravni režim na eni nepremičnini ter pomeni odstop od načela povezanosti zemljišča in objekta, zato je pred sprejemom odločitve za ustanovitev ali nakup stavbne pravice potrebno podrobno poznati razmerja med imetnikom stavbne pravice in lastnikom zemljišča. Tudi ekonomski pomen stavbne pravice je izrednega pomena, saj omogoča lastništvo zgradbe brez hkratnega lastništva zemljišča, s čimer se odpira tako možnost nakupa cenejših stanovanjskih zgradb, ne da bi se povišale cene stavbnih zemljišč, prav tako pa omogoča tudi stvarnopravno podlago za zahtevne gradbene projekte, kot na primer nadzidave, podhodi, podzemna skladišča in podobno. Diplomsko delo podrobneje osvetljuje tudi razpolaganje s stavbno pravico ter njeno obremenitvijo z drugimi stvarnimi in obligacijskimi pravicami. V slovenskem pravu se pojavljajo vedno nove pojavne oblike stavbne pravice, predvsem v zvezi z nepremičninami, ki so v lasti države in lokalnih skupnosti, pa tudi takrat, ko posamezni (specialni) zakoni posebej predpisujejo in urejajo njeno uporabo.

Title:GENERAL AND SPECIFIC REGIMES OF BUILDING RIGHTS
Abstract:The implementation of the Law of Property Code (“LPC”) introduces the institution of building rights into the Slovenian legal system. In my diploma work, I wish to present, in a comprehensive manner, this legal institute, already established in practice, yet I believe its use could have a larger scope. What leads us into making such an assumption is the situation in the house building sector, where expensive plots of land make newly built homes very expensive; the same goes for the land for the construction of industrial units. The quality of building rights is demonstrated in the delimitation of property right on land and property right on building. An important conclusion is that a different legal regime is established on a single property and that it means a derogation from the principle that the building is a part of land, which is why before making a decision to establish or acquire a building right it is essential to understand in detail the relations between a building right holder and a land owner. Moreover, the economic significance of building rights is also of utmost importance as it allows ownership of the building thus opening up a possibility to purchase cheaper residential buildings without increasing the prices of building plots. It also provides a material legal basis for complex construction projects such as superstructures, underpasses, underground warehouses etc. The diploma work also highlights more in detail the disposal of building rights and their burdening by other material and obligational rights. New building right types emerge in the Slovenian law, in particular in relation to property owned by the state or local communities or when certain (special) acts prescribe and regulate its application.
