Title:POLOŽAJ JAVNIH USLUŽBENCEV V JAVNIH ZAVODIH

Abstract:Delovna razmerja v Sloveniji za vse zaposlene tako v javnem kot v zasebnem sektorju ureja zakon o delovnih razmerjih (ZDR). Položaj javnih uslužbencev ureja zakon o javnih uslužbencih (ZJU) kot poseben zakon v razmerju do splošne delovnopravne ureditve. Za zaposlene v javnih zavodih velja le prvih 21 členov ZJU, zaradi česar se njihov položaj razlikuje od položaja javnih uslužbencev v državnih organih in organih samoupravnih lokalnih skupnosti, za katere ZJU velja v celoti. Navedeni členi določajo le skupna načela sistema javnih uslužbencev in nekaj drugih skupnih vprašanj, kot so delovanje sindikata, kolektivna pogajanja in stavka. Zato se zastavlja vprašanje, ali bi bil položaj zaposlenih v javnih zavodih zadosti varovan z ZDR in s področnimi zakoni, ki njihov položaj podrobneje urejajo, in ali bi bilo potrebno njihov položaj urejati enako oziroma podobno kot za zaposlene v zasebnem sektorju. Vendar se položaj zaposlenih v javnih zavodih razlikuje tudi od položaja zaposlenih v zasebnem sektorju, predvsem zaradi določbe tretjega odstavka 16. člena ZJU, ki prepoveduje delodajalcu, da bi določil delavcu večji obseg pravic, kot je to določeno z zakonom, s podzakonskim predpisom ali kolektivno pogodbo, če bi s tem obremenil javna sredstva. Poleg tega je za javne uslužbence določen plačni sistem po posebnem zakonu, tj. po zakonu o sistemu plač v javnem sektorju (ZSPJS). Zaradi te prepovedi je za javne uslužbence načelo in »favorem laboratoris« omejeno, za razliko od delavcev v zasebnem sektorju. Delodajalcu je prepovedano, da bi izven navedenih aktov v pogodbi o zaposlitvi določil javnemu uslužbencu večji obseg pravic in druge pravice. Pomembno pri določitvi pravic javnih uslužbencev je vprašanje opredelitve javnih sredstev, ker zakonodaja tega pojma ne definira. To pa pri poslovanju javnih zavodov odpira vrsto drugih vprašanj, zlasti glede možnosti nagrajevanja delovne uspešnosti zaposlenih oziroma določanja obsega pravic iz tega naslova. To je še posebej izraženo pri dejavnostih, ki jih javni zavodi opravljajo na trgu ob opravljanju javne službe, ki se izvaja v javnem interesu. Dodatno nejasnost vnaša neopredeljenost javne službe in javnega interesa oziroma njuna neenotna opredelitev v zakonodaji. Za varstvo javnega interesa z vidika opravljanja javnih služb je ključnega pomena opredelitev tega pojma in način njegovega uresničevanja. Glede na ohlapnost prvih 21 členov ZJU je v zvezi varstva javnega interesa z vidika opravljanja javnih služb vprašljiv tudi pomen ureditve položaja zaposlenih v javnih zavodih v ZJU.

Title:STATUS OF CIVIL SERVANTS IN PUBLIC INSTITUTIONS
Abstract:Labour relations in Slovenia for all employees in both public and private sectors is governed by the Labour Relations Act. Status of civil servants is governed by the Law on Civil Servants as a special law in relation to the overall labor organization. For employees in public institutions is relevant only the first 21st Articles Civil Servants Act, which makes their situation different from that of civil servants in state bodies and local communities, for which the Civil Servants Act applies in full. Those articles provide only the common principles of public servants and a few other common issues such as the functioning union, collective bargaining and strike. Therefore, the question arises whether the position of employees in public institutions sufficiently protected by the Labour Relations Act and sectoral laws governing their position in detail, and whether it would be necessary to regulate their position equal or similar to employees in the private sector. However, the position of employees in public institutions also differs from that employed in the private sector, mainly due to provisions of the third paragraph of Article 16 Civil Servants Act, which prohibits an employer to determine employee more rights, as provided by law, implementing regulations or by collective agreement, if this burden on public funds. In addition, certain civil servants salary system is regulated by special law, which is the Law on Salaries in the public sector. Due to this prohibition for civil servants principle in favore laboratoris is limited, unlike workers in the private sector. Employer is prohibited from being out of the acts in terms of employment provide a wider range of civil servants and other rights. Important in determining the rights of public servants is the definition of public funds, because the law does not define that term. This raises a number of other issues, especially on how to reward employee performance and determining the scope of rights under this title. This is especially evident in the activities carried out by public institutions in the market, public service, which is carried out in the public interest. Introduces additional uncertainty indifference of public service and public interest, or the definition of inequity in the law. To protect the public interest by the public service is essential to define this concept and method of its implementation. According to the slack in the first 21st Articles of the Civil Servants Act regarding the protection of public interest by the public service also questioned the importance of remedying the situation of employees in the Civil Servants Act.
