Title:Razsežnosti 3. člena Evropske konvencije o človekovih pravicah v sodbah Evropskega sodišča za človekove pravice : diplomsko delo univerzitetnega študija

Abstract:Diplomsko delo obravnava razsežnosti kršitev prepovedi mučenja, nečloveškega in ponižujočega ravnanja ali kaznovanja, ki jih je izoblikovala sodna praksa Evropskega sodišča za človekove pravice (v nadaljevanju Sodišče ali ESČP). Prepoved mučenja je absolutna in del mednarodnega običajnega prava. Do takega statusa je prišla skozi dolgotrajen razvoj. Zato je v prvem delu predstavljen kratek razvoj prepovedi mučenja v mednarodnih aktih. Nadalje se osredotočimo na predstavitev, v Svetu Evrope sprejete, Evropske konvencije o človekovih pravicah in temeljnih svoboščinah (v nadaljevanju Konvencija ali EKČP). Ta vsebuje prepoved mučenja v 3. členu, ki ga analiziramo skozi sodno prakso Sodišča. Zaradi kompleksnosti tretjega člena natančno opredelimo tri oblike ravnanj, ki jih zajema: mučenje, nečloveško ter ponižujoče ravnanje ali kaznovanje. Skozi sodno prakso je ESČP izoblikovalo minimalne standarde varstva pravic posameznikov za vsako kategorijo grdih ravnanj. Analiza sodb pokaže, da je Konvencija živ organizem, kar pomeni, da jo Sodišče razlaga v skladu z razvojem standardov varstva pravic v demokratičnih družbah. Sledi predstavitev pomena 3. člena glede na različne kategorije ravnanj (pridržanje/pripor, aretacije in zaslišanje, izročitve in izgon, razmere v zaporih/priporih, neodvisna, hitra in učinkovita preiskava). Osredotočili smo se na razmere v zaporih in priporih, kjer se je Sodišče v sodbah večkrat sklicevalo na poročila Evropskega odbora za preprečevanje mučenja ali nečloveškega in ponižujočega ravnanja ali kaznovanja (CPT). Naloga odbora je, da z obiski držav članic preiskuje ravnanje z osebami, ki jim je bila odvzeta prostost. CPT na tem področju odigra ključno vlogo, saj razvija minimalne standarde in priporočila, ki jih države članice Sveta Evrope morajo upoštevati. Na koncu predstavimo zadevo Mandić in Jović proti Sloveniji (2011), kjer je Sodišče ugotovilo, da je Slovenija kršila Konvencijo zaradi razmer v zaporih. Sodba je pomembna, ker nazorno prikaže problematiko zaporskih pogojev v Sloveniji in lepo demonstrira že razvito sodno prakso na tem področju.

Title:THE DIMENSIONS OF ARTICLE 3 OF THE EUROPEAN CONVENTION ON HUMAR RIGHTS IN CASES OF THE EUROPEAN COURT OF HUMAN RIGHTS
Abstract:The following thesis deals with the scope of prohibition of torture, inhuman or degrading treatment or punishment in case-law of the European Court of Human Rights (the Court or ECHR). Prohibition of torture is absolute and part of customary international law. We first take a look at its presence in international treaties and documents. Thesis continues with the presentation of the European Convention on Human Rights (the Convention). Article 3 of the Convention prohibits torture and despite being one of the shortest provisions in the Convention its, brevity should not belie its depth. Article 3 covers three broad areas of ill-treatment whose elements we identified through the case-law of the Court: torture, inhuman and degrading treatment or punishment. Through the years the Court has set forth minimal standards to safeguard one’s rights for each form of ill-treatment. The Court has stated in several cases that the Convention is a living instrument which must be interpreted in the light of present-day conditions. We also take on the application of article 3 in context. Most violations of prohibition of torture occur regarding to the treatment of detainees but other areas are also important: arrest and interrogation, conditions of detention, extradition and deportation, investigation of allegations of torture. Our main focus is on conditions of detention. The Court has in numerous cases cited the standards of conditions of detention adopted by European Committee for the Prevention of Torture (CPT). The CPT organises visits to places of detention, in order to assess how persons deprived of their liberty are treated and adopts minimal standards of conditions of detention. At the end of the thesis, we present Mandić and Jović v Slovenia (2011) case where the Court deemed that Slovenia has breached article 3 because of inhuman conditions of detention. The judgement clearly shows variety of problems of detention conditions in Slovenia and demonstrates developed case-law.
