Abstract:POVZETEK Diplomsko delo prikazuje pravno ureditev neformalnih varovalk s področja človekovih pravic in podrobneje pacientovih pravic, tako na državni kot na lokalni ravni. Tudi pacientom je potrebno zagotoviti temeljne človekove pravice. Izhodišče obravnave varovanja pacientovih pravic predstavlja ustavno predviden Varuh človekovih pravic in temeljnih svoboščin, ki posameznika ščiti v razmerju do državnih organov, organov lokalne samouprave in nosilcev javnih pooblastil ter posreduje v primeru kršitev pravic in drugih nepravilnosti. S svojim delovanjem je pomembno vplival na uvedbo posebnih varuhov na posameznih področjih. Na zdravstvenem področju, kjer gre načeloma za zasebnopravno razmerje med uporabnikom in izvajalcem zdravstvenih storitev, je bil najprej s strani Mestne občine Maribor vzpostavljen lokalni institut Varuh bolnikovih pravic za potrebe občanov Maribora in statistične regije Podravja, kateremu je sledilo imenovanje zastopnikov pacientovih pravic na državni ravni na podlagi Zakona o pacientovih pravicah. Ta zakon je določil hkrati pritožbeni postopek z zahtevo prve obravnave kršitve pacientovih pravic pri izvajalcu zdravstvenih storitev, če ne pride do rešitve spora z dogovorom, pa zahtevo druge obravnave pred Komisijo Republike Slovenije za varstvo pacientovih pravic s poudarkom mirnega reševanja sporov, pri katerem se subsidiarno uporabljajo postopkovne določbe Zakona o splošnem upravnem postopku. Zastopnik pacientovih pravic lahko obenem opravlja tudi funkcijo zastopnika pravic oseb na področju duševnega zdravja, v kolikor izpolnjuje pogoje in je imenovan na to funkcijo, ki varuje pravice oseb z duševnimi motnjami po Zakonu o duševnem zdravju.

Title:Legal aspects of protective institutes in the field of patients' rights in the Republic of Slovenia
Abstract:SUMMARY The present diploma work presents the legal regulation of informal legal safeguards in the field of human rights and more specifically patients' rights, at state as well as at local level. Also to patients fundamental human rights have to be assured. The starting point for study of protection of patients' rights is embodied in constitutionally envisaged Ombudsman, which protects the individual in relation to state authorities, authorities of local administration and holders of public authority and interferes when breach of rights or other irregularities. With its functioning he has significantly influenced the introduction of special ombudsmen on specific areas. In the field of healthcare, where generally private legal relationship between the user and the performer of healthcare services is to be found, firstly at the level of Municipality of Maribor local institute the Guardian of patients' rights was introduced to suit the need of people of Maribor and statistical region of Podravje, which was later followed by the establishment of Representatives of patients' rights at state level, having foundation in Patient Rights Act. Additionally this Act has also determined the appeal procedure with the demand of first discussion about the breach of patient's rights directly with the performer of healthcare services; in the case where the dispute could not be solved by the later, the demand of second discussion before Commission of Republic of Slovenia for protection of patients' rights is provided, with the emphasis on peaceful settlement of disputes, where as subsidy provisions of the General Administrative Procedure Act are used. The Representative of patients’ rights may at the same time also perform the function of Representative of rights of persons in the field of mental health, if he fulfils the required conditions and has been appointed for such function and thus ensures protection of individual's rights with mental disorders, in accordance with Mental Health Act.
